Lisa A. Schwellinger, Psy.D., filed a Petition for Variance or Waiver on September 30, 2014, which was published on October 23, 2014, in Vol. 40, No. 207, of the Florida Administrative Register. Petitioner sought a variance or waiver of Section 490.005, Florida Statutes, and Rule 64B19-11.005, F.A.C., which requires that an applicant have 4,000 hours of supervised experience – 2,000 of which can be satisfied via applicant’s internship. The Board considered the instant Petition at a duly-noticed public meeting held on November 21, 2014, by telephone conference call.
The Board’s Order, filed December 12, 2014, denied the Petition finding that same fails to demonstrate that the purpose of the underlying statute has been or will be achieved and that application of the rule imposes a substantial hardship or violates principles of fairness.

On December 11, 2014, the District's Governing Board issued SFWMD Order No. 2014-106-DAO-ROW to Broward County (Application No. 14-0812-2M). The petition for waiver was received by the District on October 16, 2014. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 40, No. 205, on October 21, 2014. No public comment was received. This Order provides a waiver of the District's criteria to allow minor design changes to the previously authorized shared-use pathway with amenities (Hiatus Greenway), including the placement of informational signs within the west and east rights of way of the C-42 Canal; Broward County, Section 6, 7, 19, 30, & 31, Township 49 & 50 South, Range 41 East. Specifically, the Order grants a waiver from Rules 40E-6.011(4),(6) and 40E-6.221(2)(j) Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in Rules 40E-6.091(1), Fla. Admin. Code, which governs the placement of permanent/semi-permanent above-ground facilities within 40 feet of the top of the canal bank within works or lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the proposed placement of informational signs will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.

The petition for waiver was received by the District on September 2, 2014. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 40, No. 175, on September 9, 2014. No public comment was received. This Order provides a waiver of the District's criteria to allow for the relocation and installation of temporary transmission lines, poles and guy anchors running parallel to and within the southerly right of way of the C-12 Canal; Broward County, Section 1, Township 50 South, Range 41 East. Specifically, the Order grants a waiver from Rules 40E-6.011(4) and (6) and 40E-6.221(2)(j) Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in Rules 40E-6.091(1), Fla. Admin.
