On December 11, 2018 the Division of Hotels and Restaurants received a Petition for a Emergency Variance for Paragraph 4-301.12(A), 2017 FDA Food Code and Paragraph 61C-4.010(5), Florida Administrative Code from KPMG LLP located in Orlando. The above referenced F.A.C. addresses the requirement that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided. They are requesting to share the warewashing located on the premises of a nearby business under the same ownership.
The Petition for this variance was published in Vol. 44/205 on October 19, 2018. The Order for this Petition was signed and approved on November 05, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring ensuring the warewashing facilites located on the premises of Lake House (SEA5814880), is maintained in a clean and sanitary manner and is provided with hot and cold running water under pressure. If the ownership of Noodle & Roll (KPMG LLP) and/or Lake House (KPMG LLP) changes, a signed agreement for use of the warewashing is required immediately.

Of the issuance of an Order granting the petition for Variance or Waiver, filed on November 18, 2019, by Jonelle Ensign. The Notice of Petition for Waiver or Variance was published on November 20, in Vol. 45, No. 226, of the Florida Administrative Register. No comments were received in response to the petition. Petitioner sought a variance or waiver from the examination score requirements of Rule 64B21-500.011, F.A.C. The Department’s Order, filed on December 17, 2019, granted the Petitioner’s request because the Petitioner demonstrated that she complied with the underlying statute requiring the school psychology testing agency to send examination scores directly to the Department by having the Texas State Board of Examiners of Psychologists, the state licensing entity which originally received her examination score directly from the testing agency, send the examination score directly to the Department.
