This rule development will address the development and amendment of consumptive use permit criteria and conditions relating to the reuse of reclaimed water. The purpose of the rule development is to implement the provisions of Sections 373.250(3)(c)-(d) of the Florida Statutes, which mandate rules to require that permit applicants provide written documentation from a reuse utility on the availability of reclaimed water. The effect of this process will be the development of proposed rule amendments to Chapter 40C-2, F.A.C., and the Applicant’s Handbook: Consumptive Uses of Water (incorporated by reference in subsection 40C-2.101(1), F.A.C.). The amendments will ensure that each permit applicant provides written documentation from a reuse utility on the availability of reclaimed water and will specify the content of the documentation required, including enough information on the availability and costs associated with the connection to and the use of reclaimed water, to facilitate the permit applicant’s evaluation of reclaimed water feasibility.

The purpose of this rule development is to fulfill requirements under Section 1012.34, Florida Statutes, to adopt the student growth formula(s) for use with statewide assessment data and to set standards for student growth performance that must be met for personnel to earn specified performance ratings on annual evaluations. It is anticipated that this rule will be revised annually as new formulas and performance standards are adopted for statewide assessments, including but not limited to, the Florida Comprehensive Achievement Test (FCAT), End-of-Course Examinations, and the Florida Alternate Assessment.

a permanent waiver of subsection 11B-27.00212(14), F.A.C., from Winter Park Police Department on behalf of one officer for the 2008 (7/1/2006 – 6/30/2008) and one officer for the 2010 (7/1/2008 – 6/30/2010) mandatory firearms requalification reporting periods. Subsection 11B-27.00212(14), F.A.C., requires officers to requalify with a firearm every two years on a course of fire mandated by Commission rule and supervised by a CJSTC-certified firearms instructor. The petition supports the requested waiver by stating that one of the officers at issue is a CJSTC-certified firearms instructor. This officer supervised his own requalification shoot for the 2008 mandatory firearms requalification reporting cycle and signed his own CJSTC 86A form. Another officer successfully completed his course of fire for the 2010 mandatory firearms requalification cycle in front of an instructor who had not completed all paperwork to become a CJSTC-certified firearms instructor. Petitioner states that the officers will suffer a substantial hardship if their certifications are rendered inactive as a result of this situation. Petitioner further states that it would violate the principles of fairness to fail to recognize that the officers did successfully complete the requirement simply because one officer supervised his own requalification shoots and signed his own CJSTC 86A form for the 2008 cycle and one officer completed his mandatory course of fire while supervised by a non-CJSTC-certified firearms instructor for the 2010 mandatory firearms requalification reporting cycle.

Petitioner states that the officers will suffer a substantial hardship if their certifications are rendered inactive as a result of this situation. Petitioner further states that it would violate the principles of fairness to fail to recognize that the officers did successfully complete the requirement simply because non-CJSTC-certified firearms instructors supervised the 2008 mandatory firearms requalification for the officers.

This meeting will provide participants an opportunity to preview the proposed design, ask questions and/or submit comments concerning the upcoming project. Maps, drawings and other information will be on display. There will be no formal presentations or testimony period. Representatives from the department will be available to answer questions and explain the project.
Currently, FDOT plans to resurface S.R. 77 from S.R. 75 / U.S. 231 to the Bailey Bridge and 1,018 feet along 23rd Street. Other proposed improvements include minor drainage upgrades, replacing traffic signal loops affected by resurfacing and pavement modifications. Deficient sidewalks will be repaired, curb ramps will be improved and pedestrian signals and controls will be installed where needed. Additional improvements will bring the roadway into compliance under the Americans with Disabilities Act (ADA). This project is approximately 5.049 miles in length and construction is expected to begin in winter of 2013.
