On December 1, 2017, the Division issued an order. The Final Order was in response to a Petition for a temporary Variance from BVIP Airport LLC dba Airport Executive, filed October 16, 2017, and advertised on October 19, 2017, in Vol. 43, No.203, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 3.11.3, A.S.M.E. A17.3, 1996 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires providing fire fighter service because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2017-185).

The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. RealPage Payments Services, LLC.; On December 1, 2017, the Florida Office of Financial Regulation (Consumer Finance) received a Petition for declaratory statement from RealPage Payments Services, LLC. The petition seeks a declaratory statement from the Office on whether Chapter 560, Florida Statutes require SSN and secondary IDs to be captured regardless if the transactions are governed by the Electronic Fund Transfer Act (15 U.S.C. 1693a(7).

Calder Race Course, Inc. (“Petitioner”); The Notice of Receipt of Petition for Declaratory Statement was published in the Florida Administrative Register on September 14, 2017 at Vol. 43, No. 178. Petitioner sought a declaratory statement from the Department (based on a representative sampling of information provided with the Petition) as to whether leased slot machines as described in the Petition qualify for the multiple quantities of a single item limitation on surtax amounts greater than $5,000 under section 212.054, Florida Statutes, and rule 12A-15.004, Florida Administrative Code. The Department’s Final Order, issued December 5, 2017, declines to issue a declaratory statement because the Petition failed to substantially comply with section 120.565, Florida Statutes, and rule 28-105, Florida Administrative Code. The Department is unable to opine on the application of section 212.054, Florida Statutes, and rule 12A-15.004, Florida Administrative Code, to all of Petitioner’s leased slot machines based on a representative sampling.
