Chapter 189, F.S. provides general provisions for the definition, creation, and operation of special districts under the Special District Accountability Act, while Sections 189.017 and .018, F.S., include a requirement that the department maintain an official listing and establish a fee schedule for special districts. Currently Rule 73C-24.003 implements these requirements by listing the information special districts are to submit for data updating and setting forth the fee schedule and invoicing process. Rule 73C-24.003 is being amended to incorporate the text of Rule 73B-24.004, which advises that the department will use data submitted by special districts to maintain an updated official list of special districts. Rule 73B-24.004 will be repealed.

that on December 7, 2016, the Assistant Executive Director of the South Florida Water Management District (SFWMD or District) issued an Order Granting Variance under Section 120.542, Florida Statutes, (SFWMD 2016-089-DAO-ERP) to the Greater Orlando Aviation Authority (GOAA), concerning a project known as the GOAA Comprehensive Conceptual Stormwater Permit Update Project, located in Orange County, Florida; Sections 1-5, 8-11, 14-17, 20-23, Township 24 South, Range 30 East and Sections 28,29,32-36, Township 23 South, Range 30 East. The Petition for Variance (Application No. 160817-7) was received by the SFWMD on August 17, 2016. Notice of receipt of the Petition was published in the Florida Administrative Register, Vol. 42, Number 162, on August 19, 2016. No public comment was received. This Order provides a variance for future construction and operation permits which modify the conceptual permit to include alternative side slope criteria for wet retention/detention and attenuation areas. The particular criterion from which the variance is sought is found at Section 5.4.2(d) of the South Florida Water Management District Environmental Resource Permit Applicant’s Handbook Volume II, effective May 22, 2016, which is incorporated by reference in Paragraph 40E-4.091(1)(a) and Chapter 62-330, Fla. Admin. Code, pertaining to degree of side slopes acceptable for wet retention/detention and attenuation areas. This criterion provides, in general, that for purposes of public safety, water quality enhancement, and maintenance, all wet retention/detention areas shall be designed with side slopes no steeper than 4:1 (horizontal:vertical) from top of bank out to a minimum depth of two feet below the control elevation, or an equivalent substitute. The Order sets forth the basis of the SFWMD decision to grant the variance, as follows: 1) the variance is necessary to prevent a substantial hardship on GOAA; and 2) the purpose of the underlying rule has been achieved by other means.
