The purpose of this Notice of Rule Development (NORD) is to revise Rules 62-204.340, and 62-204.800, F.A.C., to clarify and update references to area designations for National Ambient Air Quality Standards and designations of Air Quality Maintenance Areas, and to amend Florida’s Commercial and Industrial Solid Waste Incinerator (CISWI) regulations to provide for an equivalent alternative production-based emission limit for particulate matter.

The purpose of this Notice of Rule Development (NORD) is to repeal an obsolete and outdated rule, clarify the geographic scope of the Department’s Reasonably Available Control Technology (RACT) rules, and to complete miscellaneous regulatory cleanup. Specifically, the Division intends to repeal Rule 62-296.470, F.A.C., which has been superseded by federal standards; to revise Rules 62-296.418, 62-296.500, 62-296.600, and 62-296.700, F.A.C., to specify the counties where the rules are applicable; to revise Rule 62-296.412, F.A.C., to delete outdated provisions; and to revise Rule 62-296.512, F.A.C., to remove a reference to a test method for a pollutant that is not regulated by the rule.

To adopt new Florida Teacher Certification Examinations (FTCE) competencies and skills, effective October 1, 2020, for the following FTCE subject areas: Guidance and Counseling PK–12, Hearing Impaired K–12, Music K–12, School Psychologist PK–12, Speech-Language Impaired K–12 and Visually Impaired K–12. Examine the current fee structure for all FTCE examinations and to adopt new lower registration fees, including the lowering of fees for first-time and retake attempts. The effect will be changes to the affected FTCE competencies and skills for the affected examinations; and fee modifications to all FTCE examinations.

On February 1, 2019 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Mystical Treats LLC located in Tampa. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and the three compartment sink.
The Petition for this variance was published in Vol. 45/23 on February 4, 2019. The Order for this Petition was signed and approved on February 11, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink and the three compartment sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink and the three compartment sink is provided with hot and cold running water under pressure, and that the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

The petition was filed on behalf of Archer Funeral Home LLC, which is acquiring a funeral establishment that is a currently training agencies. Archer Funeral Home LLC seeks a waiver such that the number of cases done by the prior owner of the funeral establishment should count against the requirement of the cited rule, so that the training agency status of the funeral establishment may be continued, thus preventing the imposition of serious hardship to the interns currently training at the said funeral establishment.

S.R. 5/U.S. 1 Box Culvert Replacement Design, Financial Project ID (FPID) Number: 437937-1
Project Description: The Florida Department of Transportation (FDOT) invites all persons to a public meeting regarding the State Road (S.R.) 5/U.S. 1 Box Culvert Replacement design project from Ernest Sands Road to north of Friendship Place near Rockledge, Brevard County. The purpose of this project is to design a realignment and replacement of the existing 4-foot by 2-foot concrete box culvert with a two-barrel 6-foot by 3-foot concrete box culvert to alleviate flooding in the vicinity during and after heavy rainfall.
The public meeting is scheduled for Thursday, Feb. 28, 2019, from 5:30 p.m. to 7:30 p.m. at Friendship Fellowship at Pineda, 3115 Friendship Place, Rockledge, FL 32955. The meeting will be an informal open house during which attendees may view project information and speak with team members to learn more about the design and provide input.

The intent of this project is to evaluate multiple alternatives relative to the future of the westbound old Trammell Bridge and how these alternatives will impact motor vehicle and navigation activities along the project area, as well as identify how the bridge’s function provides service to the local community area.
There will be no formal presentation; however, maps, drawings, and other information will be on display and FDOT representatives will be available to explain proposed improvements, answer questions, and receive comments. Additional project information will also be available at www.nwflroads.com.
The environmental review, consultation, and other actions required by applicable federal environmental laws for this project are being, or have been, carried out by the FDOT pursuant to 23 U.S.C. 327 and a Memorandum of Understanding dated December 14, 2016 and executed by the Federal Highway Administration and FDOT.
