On February 5, 2018 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Good Times West located in Port St. Lucie. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink.
The Petition for this variance was published in Vol. 44/25 on February 6, 2018. The Order for this Petition was signed and approved on February 13, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring he wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

On February 8, 2018, the Agency issued a Final Order in response to a Petition for a Waiver filed by Vantrease Blair of Russell Home for Atypical Children, Inc, Petitioner on December 16, 2017. The Petition was published Florida Administrative Register on December 20, 2017.
The Final Order hereby grants the Petitioner's waiver from the following paragraphs:
65G-2.007(3)(a) FAC that states that a minimum of 35 square feet of combined living and dining area to be provided for each household member;
65G-2.007(4)(a) FAC which states that a kitchen in each residence shall be large enough to accommodate the equipment and personnel needed to prepare and properly serve the required number of meals;
65G-2.007(5)(b) FAC which states that a maximum of two residents may share a bedroom;
65G-2.014(4), FAC which states that only one facility may be sited on a single parcel of land;
The Petitioner presented competent, substantial evidence to support permanent waiver from the rules referenced.

The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 44/24 on February 5, 2018. The Order for this Petition was signed and approved on February 13, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.

State Road 10 (U.S. 90) Project Development and Environment (PD&E) Study: Financial Project Identification Numbers: 220436-2-22-01 & 220436-3-22-01. The Florida Department of Transportation (FDOT) will hold a public hearing concerning the PD&E study for widening of U.S. 90 beginning at U.S. 90 (Scenic Highway) in Escambia County and continuing to Glover Lane in Santa Rosa County, a length of approximately 11 miles. This hearing is being held to give interested persons an opportunity to express their views concerning the location, conceptual design, and social, economic and environmental effects of the proposed project. It is also being held to receive input on reclassification of U.S. 90 from west of Chumuckla Highway/Floridatown Road to west of West Spencer Field Road from Access Class 6 to Access Class 5.
The intent of this project is to widen the roadway from a four to six lane divided roadway and make access management modifications. Right-of-way acquisition will be required. The project is currently not funded for design, right-of-way, nor construction in the FDOT Five Year Work program.
Draft study documents and other information depicting the proposed improvements will be available for public review at the hearing and during regular business hours from February 1, 2018 through March 5, 2018 at FDOT’s Milton Operations Center, 6025 Old Bagdad Highway, from 7 a.m. to 4 p.m. Monday through Friday.
Written comments will be accepted at the hearing, may be mailed to Peggy Kelley, FDOT Project Manager, at 1074 Highway 90, Chipley, Florida 32428 or via email to peggy.kelley@dot.state.fl.us.
