This rulemaking will make changes to the Florida Boater Education Temporary Certificate Program, allowing it to be offered online by private vendors, and making other minor technical changes to rule language where necessary.

The purpose of this rule development is to amend the referenced rules relating to provision of services to ELLs in Florida public schools to update identification procedures for prospective ELLs to address the requirements in the Every Student Succeeds Act, Public Law No. 114-95 (2015) (“ESSA”), and to update requirements for the annual English language proficiency assessment, including the following revisions:
6A-6.0902 Requirements for Identification, Eligibility, and Programmatic Assessments of English Language Learners
This rule will be revised to meet the requirements of ESSA, namely that prospective ELLs are assessed and placed in the English for Speakers of Other Languages program within time frames established under ESSA and that parents receive timely notices that include information required under ESSA.
6A-6.09021 Annual English Language Proficiency Assessment for English Language Learners (ELLs)
This rule currently establishes the annual English language proficiency assessment only for the 2015-16 school year. The proposed revision would adopt the assessments as an ongoing requirement. In addition, the name of the Kindergarten assessment will be updated, and the proposed rule will clarify the current English language proficiency level.
6A-6.0905 Requirements for the District English Language Learners Plan
The Department’s online template ESOL 100 entitled, “District Plan for Services to English Language Learners,” which is incorporated by reference into Rule 6A-6.0905, F.A.C., will be revised to reflect revisions to the requirements of Rule 6A-6.0902, F.A.C.
6A-6.09091 Accommodations of the Statewide Assessment Program Instruments and Procedures for English Language Learners
This rule will be updated to include use of a bilingual glossary as an approved accommodation.
- Petitions and Dispositions Regarding Rule Variance or Waiver (3)

a temporary waiver of Rule 11D-8.014 F.A.C., from Shibaughan Ramsey. Petitioner wishes to temporarily waive that portion of the Rule that states: “(1) Permits to conduct blood alcohol analyses shall remain valid until otherwise suspended or revoked by the Department. In order to remain qualified for such permit, an analyst must satisfactorily determine the blood alcohol level of at least 2 proficiency samples provided by the Department semiannually…” Blood Alchohol Profieciency Cycles are currently scheduled by the Florida Department of Law Enforcement in April and September of 2017. Petitioner states that Petitioner is a blood alcohol analyst holding a current permit issued by the Florida Department of Law Enforcement; however, Petitioner is presently on leave under the Family Medical Leave Act until April of 2017. As a result of her leave of absence, Petitioner is not performing any blood alcohol analyses and therefore will be unable to participate in FDLE Blood Alcohol Proficiency Cycle 17C1, samples for which are mailed on April 3, 2017, and are due to the FDLE Alcohol Testing Program on April 28, 2017. Petitioner asserts that she would suffer a substantial hardship should the waiver not be granted, as she would be unable to work until she satisfactorily particpated in the next Blood Alcohol Permit Proficiency Cycle, samples for which are mailed on September 18, 2017, and are due to the FDLE Alcohol Testing Program on October 13, 2017. Petitioner further asserts that the purpose of the underlying statute would be achieved by the granting of the waiver as her certification is current for the present proficiency cycle, she will participate in all subsequent FDLE Blood Alcohol Proficiency Cycles following her return to work, and she will undergo routine, frequent proficiency testing by the College of American Pathologists throughout the year.

The above referenced F.A.C. addresses the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water; that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided, and that each establishment have areas of food storage. They are requesting to share the mop sink, dishwashing, and storage areas with another licensed food service establishment under the same ownership and on the same premise.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.

Grupo Regalii, Inc.; The petition sought the Office’s interpretation on the following: whether Petitioner's proposed business model (of offering an application program interface that connects service providers who provide periodic bills to consumers, such as utility and telecom businesses (" Billers"), to licensed money transmitters who accept payments from consumers. Grupo Regalii's software provides the path by which licensed money transmitters can offer real-time bill payment to consumers, even when the consumer's bills are with providers in another country) falls within the Florida Money Transmitter Statute, Chapter 560, Florida Statutes. On February 23, 2017, the Office issued a Final Order. Petitioner is a substantially affected person. The answer to Petitioner's request is that by engaging in Petitioner's proposed activity as described, Petitioner would be considered a Money Transmitter as defined by section 560.103(23 ), Florida Statutes. Petitioner is not exempt from licensure as a mere software conduit or because money transmission is merely ancillary to Petitioner's main business. Florida law (which defines "money transmitter" more narrowly than does federal law) provides no similar exemptions. The Office has insufficient information to determine whether Petitioner may be an authorized vendor of a licensed money transmitter, therefore, the Office is unable to make that determination based upon the facts contained in the Petition.

Eduardo Wolmers; Notice of the Petition for Declaratory Statement was published on December 12, 2016, in the Florida Administrative Register in Vol. 42, No. 239. The petition seeks a declaration from the Department regarding a company he intends to register with the Department of State. Petitioner asked three questions. The Department declined to respond because the petition lacked sufficient particularity to allow the Department to render a decision.
