that on February 19, 2018, an Order was filed on the Petition for Variance or Waiver. The Petition for Variance or Waiver was filed by Virginia Lawson, on December 7, 2017, seeking a variance or waiver of Rules 61J2-3.011 and 61J2-17.016, F.A.C., of the 7 hours of recertification education for instructor license.
The Commission considered the Petition at a duly-noticed public meeting held on January 17, 2018, in Orlando, Florida. At its meeting, the Commission granted the Petition. Petitioner has until September 30, 2018 to complete education requirements for renewal of her instructor’s license.

South Beach I Condo at 1400 Gulf Blvd, Clearwater, FL. Petitioner seeks an emergency variance of the requirements of ASME A17.1b-2009, Section 2.8.1, as adopted by 61C-5.001, Florida Administrative Code, that prohibits machinery and equipment not used in direct connection with the elevator, which poses a significant economic/financial hardship. On February 21, 2018 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from House of Cheung located in Boca Raton. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 44/37 on February 22, 2018. The Order for this Petition was signed and approved on March 09, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Bar and Grills (The Artful Dodger LLC), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of House of Cheung (House of Cheung LLC) and/or Bar and Grills ( The Artful Dodger LLC) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.

Extension of the Variance from Rule 59C-1.044, F.A.C., and Incorporated Memorandum of Law. This petition was filed by Public Health Trust of Miami-Dade County, Florida, as Petitioner. The Agency has assigned the variance AHCA case number 2018003595.
The rule number and nature of the rule from which the extension or waiver is sought is as follows: The rule number is 59C-1.044, F.A.C., and is entitled Organ Transplantation. The nature of the rule includes the following: This rule implements the provision of Section 408.036(1)(f), F.S., which requires the Agency to review the establishment of organ transplantation programs under the Certificate of Need program which shall include heart, kidney, liver, bone marrow, lung, lung and heart, pancreas and islet cells, and intestines. Applications for organ transplantation programs shall be reviewed against the applicable review criteria in Section 408.035, F.S., and the standards and need determination criteria set forth in this rule. This rule defines the minimum requirements for personnel, equipment, and support services for organ transplantation programs. In addition, the rule includes a need methodology for the establishment of organ transplantation programs by type.
Any interested person or other agency may submit written comments on the petition for a variance or waiver within 14 days after the notice required by Section 120.542(6), F.S to the following designated Agency representative.
