The Department proposes to correct citations and references in Chapter 62-342, F.A.C., “Mitigation Banks,” resulting from amendments to the new Statewide Environmental Resource Permitting rule Chapter 62-330, F.A.C., effective October 1, 2013, and repeal of rules in Chapter 62-312, F.A.C., and repeal of Chapters 62-343 and 62-346, F.A.C., effective November 25, 2013.
Specifically, Rule 62-342.200 and paragraph 62-342.750(1)(c), refer to the success criteria in Rule 62-312.350, F.A.C., which is now repealed. The last effective date of Chapter 62-312, F.A.C., that existed prior to its repeal (March 15, 2007), needs to be added to the above provisions in Chapter 62-342, F.A.C., so that mitigation bankers can continue to rely on those criteria.

that on March 24, 2014, the Florida Department of Environmental Protection granted a petition filed by Argus Tires Corp on February 26, 2014, seeking a variance or waiver under Section 120.542, Florida Statutes, for its waste tire processing facility located at 3594 NW 55th Street, Miami, Florida. The Petitioner requested a waiver from Rule 62-711.500(3)(a), Florida Administrative Code, which requires submittal of proof of financial assurance for closing a waste tire site at a waste tire processing facility as part of the permit application. The Petitioner demonstrated that due to the low estimated closure costs required for the facility the Petitioner will suffer a substantial and unnecessary hardship if it is required to provide financial assurance. Notice of receipt of the petition was published on the Florida Administrative Register on March 5, 2014. No comments were received.

SUMMARY DESCRIPTION OF THE FLORIDA MEDICAID FAMILY PLANNING WAIVER: The Centers for Medicare and Medicaid Services (CMS) has approved an 1115 Research and Demonstration Waiver, entitled Florida Medicaid Family Planning Waiver (#11-W-00135/4), for the periods 9/1/1998 through 08/31/2003, 12/1/2003 through 11/30/2006, 12/1/2006 through 11/30/2009, and the current period of July 1, 2011 through December 31, 2014. The State is requesting a three-year extension of this federal waiver authority for the period of January 1, 2015 through December 31, 2017.
The Florida Medicaid Family Planning Waiver seeks to improve the provision of family planning services to a population of women who otherwise may be unable to access the services, with the expectation that decreasing unintended pregnancies, increasing the child spacing interval, and referring for continuance of care will improve future birth outcomes thereby leading to net saving for the Florida Medicaid program. The waiver population consists of women, between the ages of 14 through 55, losing their Medicaid coverage who:
• Have family income at or below 185 percent of the Federal poverty level (FPL); and
• Are not otherwise eligible for Medicaid, Children’s Health Insurance Program (CHIP) or health insurance coverage that provides family planning services.
* Eligibility for the waiver services is limited to 2 years after losing Medicaid coverage, subject to an annual eligibility redetermination.
