The purpose of this rule development is to establish a standard of identity for honey that is produced, packed, repacked, distributed and sold in Florida or from Florida. Development of this rule is meant to have the effect on controlling the pervasive, illegal practice of blending or diluting pure honey with low-cost syrups (i.e., sugar, cane, corn, etc.) thereby committing an economic fraud on both the permanent and transient residents of Florida. Preliminary guidelines have been drafted through a cooperative effort between the Department of Agriculture and Consumer Services and the Florida State Beekeepers Association to implement a needed standard of identity for honey. The rule substantially conforms to standards set forth in the Codex Standard for Honey. This rule will have an effect on those establishments permitted by the Department of Agriculture and Consumer Services who produce local honey or sell honey from Interstate Commerce.

A Routine Variance for subparagraph 61C-1.002(5)(a)2., Florida Administrative Code, from Street Corner Dogs Hot Dog Cart located in Neptune Beach. The above referenced F.A.C. addresses the requirement that a mobile food dispensing vehicle be vehicle mounted on axles. This variance was approved on February 18, 2009, contingent upon the Petitioner maintaining the casters in good repair. No additional equipment is to be installed including, but not limited to, tables, chairs or non-attached cooking equipment. The unit must report to its commissary each day of operation for access to a three-compartment sink for washing and sanitizing equipment and utensils. Any violation of the variance is the equivalent of a violation of the rule and may result in a rescission of the variance and subject the Petitioner to disciplinary sanctions as enumerated in Section 509.261, Florida Statutes.

(d/b/a Derby Lane), Jacksonville Kennel Club, Inc., Orange Park Kennel Club, Inc., and Bayard Raceways, Inc. (d/b/a St. Johns Greyhound Park) (Intervenors),; The petition for declaratory statement was noticed in Vol. 34, No. 30, Florida Administrative Weekly. It sought advice on whether the pari-mutuel system of Instant Racing, an automated means of making pari-mutuel wagers on rebroadcast racing events, would be authorized for use in the State pursuant to Chapter 550, F.S. The declaratory statement issued by the Division (DBPR Case No. 20080387361/DS 2008-046) on February 26, 2009, finds that, while Instant Racing is a pari-mutuel wagering system with sufficient safeguards to ensure fairness and integrity for those playing, it does not fit within the statutory framework of Chapter 550, F.S., because it involves wagering on already run historic races, not live contemporaneous races. Accordingly, under Chapter 550, F.S., the Instant Racing system is not authorized to be employed in the state.

-
Hernando County, DCA08-DEC-153,; The Department partially granted the Petition for Declaratory Statement filed by Hernando County as it pertains to the questions of whether a binding letter of vested rights issued under Chapter 380, F.S., has the same legal effect as the issuance of a final Development of Regional Impact development order, and whether the determination of vested rights in a binding letter obviates the need to comply with all other applicable state or local government permitting procedures.
