On February 16, 2015 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Panera LLC located in Jacksonville. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within an adjacent establishment for use by customers only.
The Petition for this variance was published in Vol. 41/37 on February 24, 2015. The Order for this Petition was signed and approved on March 05, 2015. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Jack's Cleaners are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Jack's Cleaners (Jack Shakuri) changes, an updated signed agreement for use of the bathroom facilities is required immediately.

On February 26, 2015 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Bellmont Spanish Restaurant located in Coral Gables. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink in the new counter area.
The Petition for this variance was published in Vol. 41/41 on March 02, 2015. The Order for this Petition was signed and approved on March 09, 2015. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

a variance from Rule 65G-2.007(12)(e), from Advocates, Inc., Lakeside Group Home. The rule states in part, “the facility shall provide fencing of at least four feet in height in areas identified by the Agency as Hazardous”. Advocates, Inc. is requesting a variance from the requirement of a four foot fence and for the Agency to allow a three foot fence because its residents are wheelchair bound and unable to walk to any area of the outside the fenced area without staff assistance. Petitioners state that “…the fence was built…for the residents to sit on the lanai or go down to the dock and feed the fish, without obstruction of their view to the outside”. Petitioners also state that, “[l]ooking over a 4 foot fence would be difficult for the normal wheelchair person and our residents are strapped in, many in a recline position at most times due to their disabilities.” Petitioners further state that “[t]here is no reason a 4 foot fence would provide [an] additional safety benefit for the residents.”

variance or waiver of Rule 64B16-28.608, F.A.C., filed by Publix Super Markets, Inc., requesting that in the event Publix Central Fill Pharmacy’s Triple Scan System verification process is not declared to be an electronic verification process, the Board then permanently waive the rule’s requirements as applied to unit of use drugs which do not fit into the automated dispensing system. The Board will consider this petition at its meeting currently scheduled for April 8, 2015. Comments on this petition should be filed with the Board of Pharmacy, 4052 Bald Cypress Way, Bin #C04, Tallahassee, Florida 32399-3258, within 14 days of publication of this notice.

The Department of Economic Opportunity (DEO) announces a Public Hearing on the draft Analysis of Impediments to Fair Housing Choice will be held on April1, 2015, from 2:00-4:00 p.m.
PURPOSE: To conduct a public hearing to encourage citizen participation in the preparation of the final Analysis of Impediments to Fair Housing Choice (Analysis) for July 1, 2015 to June 30, 2020.
SUMMARY: The State of Florida is required to submit a three to five-year Analysis of Impediments to Fair Housing Choice to the U. S. Department of Housing and Urban Development (HUD) in order to continue to receive federal funding from HUD. The Analysis must cover the grant programs funded by HUD. Grant programs included in the Analysis are administered by four state entities: the Florida Small Cities Community Development Block Grant (CDBG) by the Department of Economic Opportunity; the Emergency Solutions Grant (ESG) by the Department of Children and Families; the Home Investment Partnership (HOME) by the Florida Housing Finance Corporation; and the Housing Opportunities for Persons with AIDS (HOPWA) by the Department of Health. The Analysis must determine the impediments to fair housing choice in Florida and include actions that can be taken to overcome these impediments.
ACTION TO BE TAKEN: At the public hearing to be held on April 1, 2015, staff from Langton Associates, Inc., the consultants preparing the Analysis for the State of Florida, will provide an overview of the draft report, answer questions, and accept comments on the draft Analysis. Interested parties are encouraged to attend. The draft Analysis will also be posted on DEO’s website at: http://www.floridajobs.org/smallcitiescdbg, on March 24, 2015.
