On March 17, 2014, the Department of Health issued an order in response to a petition for a variance filed on November 15, 2013, by Lee Rashkin, Director of Sales and Marketing, representing Presby Environmental, Inc. Petitioner sought a variance from Rule 64E-6.008(5); 009(3)(d), (e), and (j), (4), and (7)(d); .014(1)(b) and (5)(b); and .026(1), Florida Administrative Code, which requires drainfield sizing to be based on 64E-6.008 Table I and Table III or on 64E-6.009 (3)(d); the distance between the bed sidewall and center of the outside drainline to be no more than 18 inches and no less than 6 inches; and alternative drainfield materials shall not be approved with a reduction in drainfield size to be less than mineral aggregate based on using the soil surface at the bottom of the drainfield for comparison; requiring low-pressure dosing under certain circumstances; and other design requirements. Notice of the petition was published in the November 21, 2013, edition of the Florida Administrative Register.
The Department found that the Petitioner demonstrated that the underlying intent of the statute could be achieved by alternative means and that strict application of the rules would create a substantial hardship in the Petitioner's particular circumstance. Therefore, pursuant to the requirements of section 120.542(2), Florida Statutes, the Department GRANTED WITH CONDITIONS Petitioner's request for a variance.

On March 04, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Dippin Dots located in Orlando. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash and three-compartment sinks.
The Petition for this variance was published in Vol. 40/46 on March 07, 2014. The Order for this Petition was signed and approved on March 13, 2014. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash and three-compartment sinks is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash and three-compartment sinks are provided with hot and cold running water under pressure; the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

The Petitioner seeks a permanent variance or waiver of Rule 64B17-3.003(2)(a), Florida Administrative Code, with regards to the requirement that an applicant for licensure by endorsement demonstrate minimum qualifications by submiting a certified copy of the credentialing evaluation used by the licensing board of another state.
The Board=s Order, filed on March 5, 2014, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that the purpose of the underlying statute has been met by other means, and that application of the rule would cause a substantial hardship and would violate principles of fairness.
