that on March 20, 2020, an Order was filed on the Petition for Variance or Waiver. The Petition was filed by Jeffery Harris, seeking a Variance or Waiver of Rule 61G4-16.009, Florida Administrative Code, regarding the timeframes that requires that all portions of the exam must be completed in 4 years of the first attempt. The Notice of Petition for Variance or Waiver was published in Vol. 46, No. 13, on January 21, 2020, in the Florida Administrative Register. The Board, at its meeting held on February 14, 2020, denied the Petition for Variance or Waiver, finding that Petitioner failed to demonstrate a substantial hardship; failed to demonstrate that application of the rule would violate the principles of fairness; and failed to demonstrate that the purpose of the underlying statute had been met.

On March 11, 2020 the Division of Hotels and Restaurants received a Petition for a Emergency Variance for Paragraph 4-301.12(A), 2017 FDA Food Code and Paragraph 61C-4.010(5), Florida Administrative Code from OVATIONS FOOD SERVICES LP located in Ft. Lauderdale. The above referenced F.A.C. addresses the requirement that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided. They are requesting to share the warewashing located on the premises of a nearby business under the same ownership.
The Petition for this variance was published in Vol. 46/51 on March 13, 2020. The Order for this Petition was signed and approved on March 19, 2020. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the warewashing facilites located on the premises of OVATIONS FOOD SERVICES LP (NOS1625004), is maintained in a clean and sanitary manner and is provided with hot and cold running water under pressure. If the ownership of OVATIONS FOOD SERVICES LP (file: 325911) and/or OVATIONS FOOD SERVICES LP (NOS1625004) changes, a signed agreement for use of the warewashing is required immediately.
