- Petitions and Dispositions Regarding Rule Variance or Waiver (1)
-
on March 24, 2016, DOT entered an Order Granting Variance from Section 4.8.3.3 of the 2010 Utilities Accommodation Manual, incorporated by reference in Rule 14-46.001, F.A.C. On March 4, 2016, Peoples Gas System, a division of Tampa Electric Company (TECO PEOPLES GAS), requested a variance from the requirement to not place high-pressure gas or volatile fuel lines near or under DOT bridges. Notice of the Petition for Variance was published in the March 11, 2016, edition of the Florida Administrative Register. DOT granted the variance, because TECO PEOPLES GAS demonstrated that the strict application of Rule 14-46.001, F.A.C., would create a substantial hardship on Petitioner as the existing gas line cannot be relocated to avoid placement under a DOT bridge.
