Project Description: Wekiva Parkway Sections 5 and 6
Section 5 involves designing the non-tolled relocation of County Road (CR) 46A out of the Seminole State Forest, thereby improving habitat connectivity and reducing the risk of conflicts between vehicles and wildlife. CR 46A would be realigned 2.5 miles from north of Arundel Way to connect to State Road (SR) 429 east of Camp Challenge Road. Work will include designing a new two-lane, undivided roadway; drainage; signalization; signing and pavement markings; utilities and other roadway features.
Section 6 entails designing 5.5 miles of limited access toll road largely along the existing SR 46 corridor from west of Old MacDonald Road to east of Wekiva Park Road. The project will include designing a non-tolled, service road for local travel, a new bridge over the Wekiva River, as well as several wildlife bridges to allow animals to pass safely between the Seminole State Forest and Rock Springs Run State Reserve.
Work will include designing connector roads between remaining sections of CR 46A and SR 46, roadway widening, medians and turn lanes, drainage, sign and pavement markings, utilities and other roadway features. Paul and Lori Maurer; On July 31, 2014, Paul and Lori Maurer filed a Petition for Declaratory Statement. On Aug. 1, 2014, they filed a second Petition for Declaratory Statement. On Aug. 7, 2014, Petitioners filed an amendment to the Petitions. On Aug. 11, 2014, Petitioners filed a Clarification Request. The Department published notice of receipt of the Petition and Second Petition on August 8, 2014, and August 14, 2014, respectively. The petitions requested the Department’s interpretation regarding the applicability of Section 373.4211, F.S., and Chapter 62-340, F.A.C., as the law for delineating wetlands in the State of Florida, and whether such laws are binding on all political subdivisions of the State; whether such laws are binding upon Sarasota County, in particular; and whether the Department is the enforcing agency of Section 373.4211, F.S., and Chapter 62-340. The petitions also requested the agency’s opinion as to the applicability of the Mangrove Trimming and Preservation Act, §§ 403.9321-403.9333, F.S., as it applies to the petitioner, and requested the Department’s opinion regarding whether the Department has authority over mangroves within Sarasota County and whether the Department has delegated authority to administer the Mangrove Trimming and Preservation Act to Sarasota County.
There are three bases for the denial of the petitions. First, the request concerns the conduct of a third party. Rule 28-105.001, F.A.C., expressly prohibits the issuance of a declaratory statement that determines the conduct of another person other than the petitioner. Second, the Petitioners request approval or disapproval of conduct that has already occurred. Finally, the request concerns issues pending in related litigation.
