That it has issued an order on March 4, 2019, granting New River Solid Waste Association’s Petition for a Waiver. The New River Solid Waste Association intends to conduct a research project which includes evaluation of three proposed septage injection systems that discharge septage into a municipal solid waste landfill. The Petition was received January 9, 2019. A Notice of Receipt of this Petition was published in the Florida Administrative Register on January 11, 2019. The Petition requested a waiver from Rule 62-701.300(10)(a), F.A.C., which prohibits the placement of non-containerized liquid waste in solid waste disposal units. No public comment was received. The Order, file number OGC 19-0029 granted the Petition to Rule 62-701.300(10)(a), F.A.C., based on a showing that the Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.

On March 4, 2019 the Division issued an order. The Final Order was in response to a Petition for an emergency permanent Variance from Northside Generating Station, filed February 1, 2019, and advertised on February 6, 2019 in Vol.45, No. 25, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.27.3.2.1, ASME A17.1, 2013 edition, as adopted by Rule 61C-5.001 Florida Administrative Code that requires phase I emergency recall operation by fire alarm initiating devices because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW 2019-022).

variance or waiver filed by Peter Hoar, seeking a variance or waiver of Rule 61H1-27.002(2)(a), Florida Administrative Code, that requires for purposes of section 473.308, F.S., if application for licensure is made after August 1, 1983, an applicant must have at least 150 semester hours or 225 quarter hours of college education, including a baccalaureate degree or higher conferred by an accredited college or university with a major in accounting, or its equivalent. The applicant’s total education program shall include a concentration in accounting and business as follows: 30 semester or 45 quarter hours in accounting education at the upper division level which shall include coverage of auditing, cost and managerial accounting, financial accounting, and taxation. Not more than 3 semester or 4 quarter hours may be internship programs which may be applied to the 30 semester or 45 quarter hours in accounting (internship courses must be taken in conjunction with other traditional coursework at an institution and must appear on the transcript). Further, any remaining internship credit if otherwise acceptable would be applied to the general business requirement.

On February 21, 2019 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Jetpack Nutrition located in Jacksonville. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 45/37 on February 22, 2019. The Order for this Petition was signed and approved on March 05, 2019. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Kazu Japanese Restaurant (9965 San Jose Blvd Suite 35 Jacksonville, FL 32257), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Jetpack Nutrition (Peng Yi) and/or Kazu Japanese Restaurant (Kazu Japanese Restaurant Inc.) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.
