The Board’s Order, filed on March 4, 2013, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute, Section 120.542(2) Florida Statutes, would be met by granting a variance from Rule 61G4-16.005, F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned Rule to his circumstances would violate principles of fairness and impose substantial hardship.

To receive public comment and to take final action on proposed changes to the Fiscal Year 2013 Drinking Water State Revolving Fund priority list. Action will be taken under Chapter 62-552, F.A.C., to add new construction projects that submitted planning documents, plans, specifications, and permits by February 8, 2013, and pre-construction projects that submitted a complete Request for Inclusion by that date, to the contingency or fundable portion of the priority list based on availability of funds. Projects shall be subject to a segment cap limit.
The Department may accept, modify, or deny the proposed projects at the hearing. Prior to Department action at the hearing, all interested persons will have the opportunity to coment regarding any proposed actions. After the hearing, the Department will file the Notice of Final Agency Action. A copy of the Notice of Final Agency Action will be sent to local governments sponsoring the projects at issue and to any person submitting a timely written request. Such written requests must be submitted at the hearing or filed with the Department’s State Revolving Fund Program no later than 5:00 p.m. on the first working day after the public hearing.

Petitioner sought the Board’s interpretation of Rule 61G4-15.015, F.A.C., entitled “Certification of Specialty Structure Contractors.” Petitioner asks whether Petitioner’s experience building concrete skate parks will qualify Petitioner for a certified specialty license allowing him to construct concrete skate parks. The Construction Industry Licensing Board considered the Petition at its meeting held on February 15, 2013, in Altamonte Springs, Florida. The Petitioner orally requested to withdraw the Petition. The Board’s Order, filed on March 4, 2013, granted the Petitioner’s request to withdraw the Petition.
