The petition requests a variance from Rule 62-521.400(1)(l), Florida Administrative Code (F.A.C), to allow for the installation and operation of two new petroleum underground storage tanks (USTs) within the 500-foot wellhead protection area of a public water system well; the new USTs will be double-walled with automatic leak detection surpassing the environmental performance standards pursuant to Chapter 62-761, F.A.C. Rule 62-521.400(1)(1), F.A.C., only provides that new USTs must be located outside a wellhead protection area; however the rule does not reflect revised criteria for new UST systems which, due to the double-wall protection and the duplicative leak detection warning, allows safe placement of a modern UST within 500 feet of a public water system well. The front parcel has an address of 1103 Leeland Heights Boulevard West, Lehigh Acres, Florida, 33936, and the other adjacent parcels are located at 1100 and 1102 Fillmore Avenue, Lehigh Acres, Florida, 33936. that on March 6, 2017, the South Florida Water Management District (SFWMD or District) issued an Order Granting Variance under Section 120.542, Florida Statutes, (SFWMD 2017-016-DAO-ERP) to the Southport Mitigation Bank, LLC, (Southport) concerning a project known as the Southport Ranch Mitigation Bank, located in Osceola County; Sections 21-23, 25-27, 34-36, Township 27 South, Range 29 East, and Sections 30, 31, Township 27 South, Range 30 East. The Petition for Variance (Application No. 161011-9) was received by the SFWMD on October 11, 2016. Notice of receipt of the Petition was published in the Florida Administrative Register, Vol. 42, Number 203, on October 18, 2016. No public comment was received. This Order provides a variance for the proposed use of an escrow account established with the Florida Department of Financial Services in lieu of the required trust fund agreement as their financial assurance for the perpetual management activities of the Southport Ranch Mitigation Bank. The particular criterion from which the variance is sought is found at Section 4.4.10.5 of the Basis of Review for Environmental Resource Permit Applications within the South Florida Water Management District, pertaining to financial responsibility for the long term management of mitigation banks. This criterion provides, in general, that financial responsibility for long term management of mitigation banks can only be established through a fully funded trust fund agreement. The Order sets forth the basis of the SFWMD decision to grant the variance, as follows: 1) the variance is necessary to prevent a substantial economic hardship on Southport; and 2) the purpose of the underlying rule has been achieved by other means.

Southern Boulevard/State Road 80 Bridge Replacement project, from Washington Road to State Road A1A/South Ocean Boulevard, in Palm Beach County. (FIN: 419013-1-52-01)
The Southern Boulevard Bridge Replacement Project consists of replacing the existing bascule bridge and tide relief bridge over the Intracoastal Waterway and Lake Worth Lagoon between the Town of Palm Beach and City of West Palm Beach. New decorative lighting, pedestrian features, traffic signals and drainage are included. A temporary bridge will be built north of the existing bridge to maintain traffic while the replacement bascule bridge is under construction. Construction will begin in spring 2017 and be completed by late 2020. The estimated construction cost is $93 million.
During the informal open house, attendees will have the opportunity to review renderings of the new bascule bridge, the construction plans and traffic control plans. FDOT staff and consultant staff members will be available to discuss the project and answer questions.

The Florida Department of Transportation (FDOT) will host a public information open house Tuesday, March 21, regarding the State Road (S.R.) 30 (U.S. 98) Pensacola Bay Bridge replacement project.
The $398.5 million project will construct a new bridge across Pensacola Bay in Escambia and Santa Rosa counties. The new bridge will consist of two structures, one for eastbound and one for westbound traffic. Each structure will accommodate three 12-foot travel lanes, ten-foot inside and outside shoulders, and a 10-foot multi-use path for pedestrians and bicyclists.
Work is scheduled to begin in March 2017 with completion currently slated for summer 2020.
Maps, drawings and other information will be on display. There will be no formal presentation; however, representatives from FDOT will be available to discuss the project plans, answer questions, and receive comments.

Paul J. Del Vecchio; The Notice of Petition for Declaratory Statement was published in Volume 42, No. 246, of the December 21, 2016, Florida Administrative Register. Petitioner asks the Board the following two questions: (a) Can an interior designer licensed under Chapter 481, Fla. Stat., but not licensed under Chapter 489, Fla. Stat., enter into a contract directly with a homeowner to offer construction services provided he/she hires licensed contractors to obtain permits and perform construction activities? (b). If a licensed contractor enters into the above agreement with a licensed interior designer is he/she aiding and abetting unlicensed activity? The Board’s Order, filed on March 2, 2017, declines to issue a declaratory statement on the first question because the Board does not have jurisdiction over Chapter 481, Fla. Stat., and the Petition asks about the conduct of another person. The Board answers the second question in the affirmative. The applicability of this Declaratory Statement is limited to the set of facts incorporated herein.
