Changes to rule 60A-1.006, Vendors and Contractors, removes unnecessary wording, language repetitive of statute, and provides clarification of the responsibilities of vendors, agencies, and the Department when a vendor fails to fulfill its specified contractual duties.

The purpose of the rule amendment is to modify Form DR-505, titled “Report of Discounts, Errors, Double Assessments, and Insolvencies,” to comply with section 197.492, Florida Statutes. The tax collector prepares this form and certifies it to the Board of County Commissioners (BOCC) of the same county. The form removes the requirement for the BOCCs to review the report for tax roll purposes. The effect of the amendment would allow the form to be more informative and reduce the BOCC’s duties. This is a substantial revision of the rule to remove language duplicative of statutue, eliminate antiquated language and revise wording to reflect best practices. The changes also include revision of materials incorporated by reference and simplify agency requirements for managing purchases of commodities or contractual services.

On April 4, 2017, the Department received a request withdrawing the Petition for variance from Ocean Gallery, filed February 17, 2017, and advertised on February 23, 2017 in Vol.43 No.37 of the Florida Administrative Register. The Petition for variance requested a variance from ASME A17.1, Section 8.7.3.31.5(a), 2009 edition, as adopted by 61C-5.001(1), Florida Administrative Code that requires upgrading the elevators for firefighters’ emergency operations. The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety is taking no further action on the petition (VW2017-017).

On April 7, 2017, the Department received a request withdrawing the Petition for variance from Lakeshore Colony No 1 Condominium Association, filed March 17, 2017, and advertised on March 22, 2017 in Vol.43 No.56 of the Florida Administrative Register. The Petition for variance requested a variance from ASME A17.1b, Section 3.4.5, as adopted by 61C-5.001(1), Florida Administrative Code that requires a minimum car top clearance. The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety is taking no further action on the petition (VW2017-041).
