The Notice of Petition for Variance or Waiver was published in Vol. 44, No. 248, of the December 24, 2018, Florida Administrative Register. Petitioner sought a variance from or a waiver of Rule 64B2-13.004(5)(c)1., F.A.C, which requires that all continuing education courses be submitted for board review and approval at least sixty (60) days prior to the course offering date. The Board considered the instant Petition at a duly-noticed public meeting held on January 25, 2019, in Orlando, Florida. The Board’s Order, filed on February 15, 2019, granted Petitioner a partial permanent waiver from the requirement that the course “Amazing Balancing Act of the Woman Chiropractor” be submitted for approval more than 60 days prior to the course being offered finding that Petitioner achieved the purpose of the underlying statute by other means, and that compliance with the rule’s provisions would violate principles of fairness. The Petitioner is granted in part with the exception of the modules/components identified below. Attendees of the course may not receive CE credit for these modules attended, but may receive credit for all other modules attended.

The Board’s Order, filed March 6, 2019, finds that granting a waiver of the requirements of the rule would achieve the underlying purpose by other means and would overcome a substantial hardship on Petitioner and course attendees. Rule 65C-14.023(15)(c), F.A.C., requires residential child-caring agency staff responsible for the supervision, evaluation and monitoring of the direct care staff shall have a bachelor’s degree in social work, or in a related area of study from an accredited college or university, and at least two (2) years of experience working with children or two (2) years of college and four (4) years of experience working with children.
