Upon expiration of this time period, the storage tank system must be closed in accordance with subsection 62-761.800(2)(b), F.A.C. The 12,000-gallon secondarily contained underground storage tank has been out-of-service greater than 14 continuous years, and is requesting a waiver of the rule to be placed back into service. The proposed storage tank facility is located at 4300 Ravenswood Road, Dania Beach, Florida 33312, in Broward County. The petition has been assigned File No. DWM FACID 06/8622379 and OGC File No. 18-0192.

The Notice of Petition for Waiver or Variance was published in Volume 42, Number 14, of the January 22, 2016, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B3-11.001, Florida Administrative Code, entitled, “Continuing Education,” which requires that in order to renew a clinical laboratory personnel license, a minimum of 24 contact hours of continuing education shall be earned during each biennium including a minimum of one contact hour for each of the categories in which the individual is licensed.
The Board considered the instant Petition at a duly-noticed public meeting, held on March 4, 2016, in Orlando, Florida. The Board’s Order, filed on March 22, 2016, granted the petition finding that Petitioner established that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B3-11.001, F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.

The Department issues an open invitation to interested individuals to attend one of two public informational webinars on Florida’s Diesel Emission Mitigation Program. This program stems from the United States government’s settlement with Volkswagen resolving claims that it violated the Clean Air Act by selling diesel vehicles that violated the U.S. Environmental Protection Agency’s mobile source emission standards. Both webinars will consist of a presentation describing the mitigation planning process and an opportunity for question and answers. The webinar content will be identical to the content that Department representatives presented at five recent in-person public meetings held during the weeks of March 19 and March 26. All presentation materials used at the in-person meetings and webinars will be posted to the Department’s website in the coming weeks.
The Department respectfully requests that persons planning to attend either webinar submit an RSVP through the webinar links above, through links provided on the Department’s website, via e-mail to the Department at VWMitigation@floridadep.gov, or by contacting John Paul Fraites at (850) 717-9021.
The Department also reminds all interested individuals of the opportunity to complete a related online public survey: Diesel Emissions Mitigation Program Public Survey. This survey opened on March 13, 2018, and will close on May 12, 2018. The Department will use responses obtained through this survey in developing Florida’s State Beneficiary Mitigation Plan. Individuals interested in submitting general comments on Florida’s approach to developing the State Beneficiary Mitigation Plan may also e-mail those comments to VWMitigation@floridadep.gov. At this time, the Department is focused exclusively on the development of Florida’s State Beneficiary Mitigation Plan. The Department is not soliciting funding requests or proposals for any specific diesel emissions mitigation project.
