The purpose and effect of the proposed rule is to enable the Department to suspend a visitor’s visitation privileges if they conspire or agree to introduce contraband into an institution or they solicit, encourage, hire or request another person to engage in such conduct.

The revisions in the proposed amendment are intended to conform Rule 69B-231.150, F.A.C. relating to administrative license actions based on criminal proceedings to changes already made to Rule 69B-211.042, F.A.C. Subsections (1) and (2) are amended to clarify what is meant by the terms “felony” and “revocation”. Also, the word “immediate” is removed to better reflect the administrative process requirements which exist. Subsection (3) is deleted to remove standards which are in conflict with statutory changes. A new Subsection (3) is added to conform the penalty scheme with Section 626.207, F.S., and Rule 69B-211.042, F.A.C. Subsection (4) incorporates definitions from Section 626.207, F.S. Subsection (5) adds qualifications for administrative actions based on criminal proceedings outside the United States.

The proposed rule clarifies Florida fire safety standards for elevators through the adoption of Rule 61C-3.012, F.A.C., “Standards of the National Fire Protection Association and Other Standards Adopted,” and Rule 61C-5.001, F.A.C., “Safety Standards.”

variance from Robert and Rhonda Ficocelli, 11131 117th Lane, Seminole, FL 33778, pursuant to Section 120.542, F.S. Petitioner is seeking variance from subsection 40B-4.3030(12)(b), F.A.C., as to the 75-foot setback requirement. Petitioner states this would allow replacement of an existing mobile home and deck while not increasing encroachment into the 75-foot setback. Petitioner states that if building was reconstructed outside of the 75-foot top of bank setback, the proposed reconstruction would encroach on an adjacent wetland, causing impacts to the wetland. The project is located in Dixie County, Township 9 South, Range 13 East, Section 36. These rules are intended to set forth criteria for development activities within a Work of the District. The petition has been assigned ERP Number 06-0392M, Robert Ficocelli District Floodway Project.

NWFWMD is developing changes to Chapter 40A-2, F.A.C., as noticed in Florida Administrative Weekly on July 20, 2012, as part of a statewide effort headed by the Florida Department of Environmental Protection (DEP) and joined by all five water management districts (WMDs), to increase consistency in the consumptive use permitting (CUP), minimum flows and levels (MFLs), and water supply related programs of the WMDs.
SUBJECT AREA TO BE ADDRESSED: Among other things, this rule development will cover the amendment, repeal, or development of rules as needed to accomplish CUP consistency goals, on the following subjects: (1) consumptive use permit criteria; (2) limiting conditions (permit conditions by rule); (3) permit thresholds; (4) permit types; (5) permit duration; (6) water conservation requirements; (7) annual allocation requirements and other rules needed to provide continuous reasonable assurance throughout the duration of a permit; (8) modification of permits; (9) 10-year compliance reports; (10) compliance monitoring and forms; (11) application forms; (12) permit fees to address related changes to permit thresholds or permit types; (13) an Applicant’s Handbook to assist applicants with the requirements of Chapter 40A-2, F.A.C. (14) procedural rules in Chapter 40A-1, F.A.C.; (15) water shortage plan rules in Chapter 40A-21, F.A.C.; and (16) other rules for which conforming amendments may be needed along with any rule changes made in the subject areas identified above.

Mark A. Cramer; Petitioner sought clarification regarding the use of a home inspector license to identify and sample mold in a 10 sq. ft area. The Petition was granted, and stated that Petitioner may inspect, sample, and identify visible mold, assuming the visible mold discovered during the home inspection is less than 10 square feet in area, and Petitioner is allowed to advertise mold testing, sampling, and inspections within the scope of licensure as a home inspector, so long so long as he does not use the terms “certified mold assessor,” “registered mold assessor,” “licensed mold assessor,” “mold assessor,” “professional mold assessor,” or any combination thereof stating or implying licensure as a mold assessor.
