On April 12, 2019, the Florida Housing Finance Corporation issued an order granting the variance from Rules 67-21.027(1) and 67-21.003(1)(b) F.A.C. for Centerra Associates, Ltd., to allow for calculation of the minimum set aside percentage based on income averaging. Florida Housing determined that the Petitioner had demonstrated that it would suffer a substantial hardship if the waiver was not granted. The petition was filed on March 13, 2019 and notice of the receipt of petition was published on March 15, 2019 in Vol. 45, Number 52, F.A.R.

variance of section 3.5.1B of the Child Care Facility Handbook, which is incorporated by reference in subsection 65C-22.001(6), Florida Administrative Code, from Jump Dance Company, assigned Case No. 19-007W. Section 3.5.1B of the Child Care Facility Handbook requires in pertinent part that fencing, including gates, must be continuous and must not have gaps or opening larger than 3 ½ inches that would allow children to exit the outdoor play area. Subsection 65C-22.001(6), F.A.C., states in pertinent part that child care programs must follow the standards found in the “Child Care Facility Handbook,” October 2017, incorporated herein by reference.
