- Notices of Petitions and Dispositions Regarding Declaratory Stat (3)
-
Alan Brotz and Brian Miller; The following is a summary of the agency’s declination of the Petition: The Notice of Petition for Declaratory Statement was published in Volume 44, No. 25, of the February 6, 2018, and Volume 43, No. 155 on July 11, 2017, Florida Administrative Register. Petitioner asks the Board for clarification of Rule 61G4-12.011(15), F.A.C., as it relates to a licensed pool/service contractor installing or replacing electrical circuits on the load side of the dedicated pool equipment disconnect panel when installing or replacing pool equipment. The Board considered the Petition at its meeting held on March 16, 2018, in St. Augustine, FL. The Final Order was filed on April 10, 2018. The Petitioner’s petition appears to apply to the conduct of another, which is inappropriate for a declaratory statement as outlined in Rule 28-105.001, F.A.C., and appears to relate to general applicability, which has previously been addressed in rule. It is the Board’s opinion that Rule 61G4-12.011(15), F.A.C., is not ambiguous, and declines to clarify the rule.
-
Patrick J. Hubbard; The Notice of Petition for Declaratory Statement was published in Volume 44, No. 25, of the February 6, 2018, Florida Administrative Register. Petitioner asks the Board for clarification of s. 489.113(9)(b)2, F.S., with regard to the need for an engineer or architect for Division 1 or 2 work performed pursuant to this section. The Board considered the Petition at its meeting held on March 16, 2018, in St. Augustine, FL. The Final Order was filed on April 10, 2018. The Petitioner’s petition is vague and does not state a particular set of circumstances to which the statute in question would apply as required by s. 12.565, F.S. It is the Board’s opinion that s. 489.1163(9)(b)2, F.S., is not ambiguous, and declines to clarify the statute.
