This action is taken to repeal the entirety of the subject rule and its incorporated forms based upon the Florida Supreme Court’s opinion in Browning v. Florida Hometown Democracy, Inc., No. SC08-884, (Fla. Feb. 18, 2010), that the revocation provisions of Section 100.371, Florida Statutes, and this rule violate the Florida Constitution and are void and without effect.

Rule 25-22.061, F.A.C., Stay Pending Judicial Review, is amended for consistency with Florida Rule Appellate Procedure 9.310, and to clarify who shall hear motions for stay and what factors are considered by the Florida Public Service Commission in granting a stay and in setting an interest rate when a stay is conditioned upon the posting of a bond or corporate undertaking. Docket No. 100062-OT.

The proposed rule will establish universal patient authorization forms in both paper and electronic formats which may be used by a health care provider to document patient permission for the disclosure and use, in any form or medium, of an identifiable health record. The universal patient authorization forms must be accepted by a provider as valid authorization to release an identifiable health record if the form is completed according to the instructions accompanying the form. The proposed rule will incorporate by reference a full disclosure form for treatment and quality of care purposes and limited disclosure form that may be used for treatment or certain non-treatment purposes.

The purpose and effect of the proposed rules is to specify that an inmate in administrative confinement may possess religious items pursuant to Rule 33-602.201, F.A.C., to clarify visiting procedures for inmates in administrative confinement, to clarify the visiting procedure for inmates in protective management, to specify that an inmate in disciplinary confinement may possess religious items pursuant to Rule 33-602.201, F.A.C., and to strike language that prohibits inmates in confinement settings from being provided typing services.

The proposed rule amendment amends the ACCESS Florida Application, CF-ES 2337, amends the interview requirements, incorporates forms that can be used in the eligibility determination process, and includes some wording changes and technical changes of a non-substantive nature improving the overall content of the rule.

The Department is adopting the federal Stage 2 Disinfectants and Disinfection Byproducts Rule (Stage 2 D/DBPR) that is incorporated in the federal regulations in the July 1, 2009, edition of 40 CFR 141. There were errors in the notice that was published in the Florida Administrative Weekly on March 12, 2009, in the three tables incorporated into the two above-listed rules. These two rules are being withdrawn and that notice is published concurrent with this notice. The remaining rules that were noticed on March 12, 2009, are part of the Department’s adoption of the federal Stage 2 Disinfectants and Disinfection Byproducts Rule. Specifically, Rule 62-550.310, F.A.C., is being amended to expand the applicability of the chlorine and chloramine maximum residual disinfectant levels (MRDLs) in accordance with the Stage 2 D/DBPR; to clarify that the Stage 1 D/DBPR MCLs for total trihalomethanes (TTHM) and haloacetic acids five (HAA5) apply until the date specified for compliance with the Stage 2 D/DBPR MCLs for TTHM and HAA5; and to specify the Stage 2 D/DBPR MCLs for TTHM and HAA5, the water systems to which these MCLs apply, and the effective dates for these MCLs. Rule 62-550.500, F.A.C., is being amended to clarify that the monitoring and compliance measurement requirements in the Stage 2 D/DBPR take precedence over the general monitoring and compliance measurement requirements in Rule 62-550.500, F.A.C.

a temporary waiver of paragraph 11B-21.005(8)(a), F.A.C., from Director William Wall and the Sarasota Criminal Justice Academy. The Petitioner wishes to waive that requirement of rule which mandates that training schools operate on a 12-month calendar for all full-time instructional positions. The Petitioner operates under the umbrella of the Sarasota County Technical Institute. The Institute has made budget cuts in compliance with the reduction of workforce education training monies. These budget cuts require the various components of the Institute to reduce their instructional staff from 12-month to 11-month contracts. Petitioner states that it has no option but to comply. Petitioner, therefore, requests that the Commission waive that portion of paragraph 11B-21.005(8)(a), F.A.C., which requires training school instructional staff to operate on 12-month, full-time contracts.

SFWMD Order No.: 2010-060-DAO-ROW was issued to Fernando Munilla (Application No.: 09-0508-1). The petition for waiver was received by the SFWMD on July 17, 2009. This Order provides a waiver of the District’s criteria to allow existing trees that are within 40 feet from top of bank on the west right of way of C-100C Canal at the rear of 14221 S. W. 78th Court, Palmetto Bay, FL to remain; Section 22, Township 55 South, Range 40 East, Miami-Dade County. Specifically, the Order grants a waiver from subsections 40E-6.011(4) and (6), Florida Administrative Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in subsection 40E-6.091(1), Florida Administrative Code, which governs the placement of permanent and/or semi-permanent above-ground facilities within forty feet of the top of the canal bank within works or land of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver, as follows: 1) the facilities will not significantly interfere with the District’s current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule would prevent Petitioner from a suffering a substantial hardship and is also based upon principles of fairness.

Pedro F. Ruiz, seeking a variance or waiver of paragraph 61H1-27.001(5)(a), Florida Administrative Code, which lists the requirements for an applicant for licensure who holds a degree from an college that is not accredited. Petitioner also seeks a variance or waiver of paragraph 61H1-27.002(3)(b), Florida Administrative Code, which requires that an applicant for the licensure examination have 24 semester or 36 quarter hours in general business education to include not less than the equivalent of 6 semester or 8 quarter hours in business law courses with coverage of the uniform commercial code, contracts and torts.

The Department received an Emergency Variance for Section 509.221(1)(b), Florida Statutes, paragraph 61C-1.004(2)(a), subsections 61C-4.010(6), (7), Florida Administrative Code, and Section 6-402.11, 2001 FDA Food Code from Caliyogurt located in Orlando. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees. They are requesting to utilize public bathrooms located more than 300 feet away in a mall for customers and employees.
The variance request will be published in Vol. 36, No. 12 on 3/26/10 and approval is contingent upon The Petitioner ensuring the public bathrooms located in the Florida Mall are maintained in a clean and sanitary manner and are provided with hot and cold running water under pressure, soap, approved hand drying devices, handwashing signs and are available during all hours of operation. Petitioner shall also ensure directional signage is installed within and outside the establishment clearly stating the location of the bathrooms. If the circumstances governing access to the public bathrooms change, this variance approval will be revisited.

The Department received a Petition for an Emergency on March 10, 2010 for Section 509.221(1)(b), Florida Statutes, subsection 61C-1.004(1), paragraph 61C-1.004(1)(d), Florida Administrative Code, and Paragraph 5-202.11(A), 2001 FDA Food Code from Xtreme Indoor Karting Bar, Fort Lauderdale, FL. The above referenced F.A.C. addresses the requirement that each establishment discharge sewage into an approved collection system and have an approved plumbing system installed. They are requesting to utilize holding tanks to provide potable water and to collect waste waster.
The variance request will be published in Vol. 36, No. 12 on 3/26/10 and approval is contingent upon The Petitioner ensuring the waste water holding tanks for the bar hand wash sink are emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the hand wash sink is provided with hot and cold running water under pressure, soap, approved hand drying devices and a handwashing sign.

The Order is on the Petition for Variance or Waiver filed on November 10, 2009, by Vivekanand Y. Aher. Petitioner was seeking a variance or waiver of Rule 64B16-26.2031, Florida Administrative Code, entitled “Licensure by Examination; Foreign Pharmacy Graduates,” The Notice of Petition published on December 24, 2009, in Vol. 35, No. 51, of the Florida Administrative Weekly.
The Board of Pharmacy considered the Petition at a duly-noticed public telephonic meeting held on January 19, 2010. The Board’s Order denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute, Section 465.007, Florida Statutes, would be met by granting a variance or waiver from Rule 64B16-26.2031, F.A.C. The Board further finds that the Petitioner had not established that applying the requirements of the aforementioned rule to Petitioner’s circumstances would violate principles of fairness and impose substantial hardship.

The Department’s decision was made to relieve the Petitioner’s hardship due to the cost and complexity of this upgrade. The request for variance was published in the 3/26/10 edition of the F.A.W. Vol. 36, No. 12 (VW 2010-133).

a temporary (three year) variance from portions of the Manatee County manatee protection Rule 68C-22.014, Florida Administrative Code, that establish Slow Speed boat speed zones in the Anna Maria Island area. The petition was submitted by Nick Taylor, and seeks authorization for the applicant or others associated with the applicant to operate a personal watercraft (PWC) at speeds greater than Slow Speed (up to 20 MPH) in 14 shallow water areas while wakeskating. The petition describes wakeskating as being visually comparable to skateboarding on water; most often, the wakeskater is pulled by a PWC, with the wakeskater not attached to the board but instead relying on friction from the sandpaper-like board surface, the same as skateboarding. The petition states the applicant earns his living wakeskating and needs the variance to continue his profession. Comments regarding the petition will be accepted for no less than 14 days from the date of publication of this notice.

a temporary variance from the portion of the Martin County manatee protection Rule 68C-22.024, Florida Administrative Code, that establishes a Slow Speed boat speed zone west of the Intracoastal Waterway channel and immediately north of the Jensen Beach Causeway. The petition was submitted on behalf of the Treasure Coast Boat Racing Association, and seeks authorization for the applicant to hold a powerboat racing event between 10:00 a.m. and 6:00 p.m., April 24-25, 2010. Races would involve hydroplane and Jersey skiffs style vessels of varying size classes between 13.5 and 26.5 feet in length. Multiple time trials, heats, and finals would be run each day over an approximately 6,600-foot oval course. Boat speeds would exceed 100 miles per hour. Comments regarding the petition will be accepted for no less than 14 days from the date of publication of this notice.

Eric A. Neilinger, Petitioner.; Miami Dade county fire appeal board excludes licensed fire alarm contractors from appealing rejections of plans or installation. Pursuant to their submittal for appeal the following is extracted from their process: It is required that the application be filed by the owners of the property which is the subject of the application, the owner or attorney must be present at the hearing. This is in direct conflict with the FFPC, not allowing due process for all effected people. As a licensed fire alarm contractor, we design and build systems based on code requirements. It is our responsibility to the owners to install a code compliant system. When AHJs ask for more than the code required that is clearly documented, we must be able to have an avenue to appeal this process without having to go directly to the state. State Fire Marshal requires a local appeal process to be used prior to appealing to the state Fire Marshal office. Question: Can the local Fire Appeals board exclude other affected parties from the local appeal process, and can the locally affected party, in this case a licensed fire alarm contractor bypass the local board and submit the state for a declaratory statement.
