The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees. They are requesting to share the bathrooms located within an adjacent establishment under different ownership for use by both customers and employees.

The above referenced F.A.C. addresses the requirement that each establishment have facilities for manually washing, rinsing and sanitizing equipment and utensils. They are requesting to share the warewashing sink area with another licensed food service establishment under the same ownership and on the same premise.

On May 14, 2015, the District's Governing Board issued SFWMD Order No. 2015-029-DAO-ROW to Frederick and Tanya McLendon (Application No. 07-0927-1). The petition for waiver was received by the District on March 15, 2015. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 41, No. 56, on March 23, 2015. No public comment was received. This Order provides a waiver of the District's criteria to allow an existing fence and eight palm trees to remain within the north right of way of the North New River Canal; Broward County, Section 12, Township 50 South, Range 40 East. Specifically, the Order grants a waiver from Rules 40E-6.011(4) and (6), Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in Rules 40E-6.091(1), Fla. Admin. Code, which governs the placement of permanent/semi-permanent above-ground facilities within 40 feet of the top of the canal bank within works or lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the existing fence and palm trees will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.

The petition for waiver was received by the District on March 2, 2015. Notice of receipt of the petition requesting the waiver was published in the Florida Administrative Weekly, Vol. 41, No. 44, on March 5, 2015. No public comment was received. This Order provides a waiver of the District's criteria to allow for the relocation of an existing aerial powerline crossing the Dania Cut-Off Canal right of way located immediately west of the Ravenswood Road bridge; Broward County, Section 28, Township 50 South, Range 42 East. Specifically, the Order grants a waiver from Rules 40E-6.221(3)(j), Fla. Admin. Code, and the Basis of Review for Use or Occupancy of the Works or Lands of the District, incorporated by reference in Rules 40E-6.091(1), Fla. Admin. Code, which governs the vertical clearance of transmission lines within works or lands of the District. Generally, the Order sets forth the basis of the Governing Board decision to grant the waiver as follows: 1) the existing fence and palm trees will not interfere with the District's current ability to perform necessary construction, alteration, operation, and routine maintenance activities; and 2) the Order granting a waiver from the subject rule is based upon a substantial hardship.

Rule 65C-13.030(3)(i)12, F.A.C.,states children over the age of twelve months shall not share a bedroom with an adult. The only exception to this would be if one of the children sharing a bedroom reaches his or her eighteenth birthday and the out-of-home caregiver and the supervising agency approve this sleeping arrangement. This exception applies only to the circumstances described above and not to any new placements in the home.

The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater; that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided, and that each establishment have areas for food storage\preparation. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and to share the dishwashing and food storage\preparation areas with another food service establishment under a different ownership but on the same premise.
