On May 05, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 4-301.12(A), 2009 FDA Food Code and Paragraph 61C-4.010(5), Florida Administrative Code from Stoneybrook East Golf Club located in Orlando. The above referenced F.A.C. addresses the requirement that dishwashing facilities for manually washing, rinsing and sanitizing equipment and utensils are provided. They are requesting to share the three-compartment sink located within an adjacent business under the same ownership.
The Petition for this variance was published in Vol. 40/89 on May 07, 2014. The Order for this Petition was signed and approved on May 13, 2014. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that the dishwashing area within Stoneybrook Golf Club (SEA5808822) is maintained in a clean and sanitary manner, provided with hot and cold running water under pressure and is available during all hours of operation. If the ownership of Stoneybrook Golf Club (SBEGC LLC) changes, an updated written agreement must be provided to the division immediately.

On May 07, 2014 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Smokin Legs located in Panama City Beach. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash and three-compartment sinks.
The Petition for this variance was published in Vol. 40/90 on May 08, 2014. The Order for this Petition was signed and approved on May 14, 2014. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash and three-compartment sinks is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash and three-compartment sinks are provided with hot and cold running water under pressure; the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

The above referenced F.A.C. addresses the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water; that at least one accessible bathroom be provided for use by customers and employees. They are requesting to utilize the mopsink and bathroom facilities located within an adjacent establishment under a different ownership for use by customers and employees.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received on or before 5:00 p.m.

of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on February 24, 2014, by Jay M. Littlefield II, D.C. The Notice of Petition for Waiver or Variance was published in Volume 40, Number 46, of the March 7, 2014, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B2-13.007, Florida Administrative Code, which requires that for the purpose of renewing or reactivating a license, an applicant must demonstrate to the Board that he/she has participated in at least forty (40) classroom hours of Board approved continuing chiropractic education, including at least three (3) hours in risk management, and two (2) hours in the area of Florida laws and rules. The Board considered the instant Petition at a duly-noticed meeting, held April 4, 2014, in Orlando, Florida.
The Board’s Order, filed on April 22, 2014, grants a temporary waiver of Rule 64B2-13.004, Florida Administrative Code. The Board finds that Petitioner met the purpose of the underlying statute and demonstrated that application of the rule at issue to Petitioner would violate principles of fairness. However, the Petitioner must complete two hours of Florida chiropractic laws and rules continuing education by June 30, 2014. This waiver applies to the 2012-2014 licensure biennium only.
