On May 19, 2015 the Division issued an order. The Final Order was in response to a Petition for a Permanent Variance from Strahl Place, filed February 20, 2015, and advertised on February 25, 2015 in Vol. 41, No. 38, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance to allow prohibited door from Rule Chapter 3002.6, 2010 Florida Building Code, because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-047).

Petitioner is also seeking a variance or waiver of Rule 61G1-22.002(1), Florida Administrative Code, which requires that applicants must obtain the diversified interior design experience required by Section 481.209(2), F.S., with a registered interior designer (any state) or registered architect (any state) performing interior design services, unlicensed interior designer (outside of Florida) who has passed the NCIDQ (National Council for Interior Design Qualification) or the AID (American Institute of Designers) examination, or unlicensed interior designer (outside of Florida) who would have met the six-year experience grandfather requirement of Section 21, Chapter 88-383, Laws of Florida.

On May 07, 2015 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from EA Tiburon Cafe located in Maitland. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink in the new preparation area.
The Petition for this variance was published in Vol. 41/92 on May 12, 2015. The Order for this Petition was signed and approved on May 19, 2015. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

Financial Project ID Number: 433693-2-22-01 – a public meeting is being held for the Interstate 4 (I-4) Poinciana Parkway Connector Project Development and Environment (PD&E) Study. The purpose of the study is to evaluate options for new or enhanced roadway connections from I-4 to the greater Poinciana area in Osceola and Polk Counties. The panel will hear presentations from qualified entities, and discuss and select a qualified, independent entity for the Florida Department of Education to contract with to complete verification of the 2014-2015 Florida Standards Assessment.
CS/HB 7069, passed by the Legislature and signed by Governor Scott (ch. 2015-6, L.O.F.), established the Florida Standards Assessment Review Selection Panel comprised of three members, one selected each by the Governor, the President of the Senate, and the Speaker of the House of Representatives. The panel has been tasked to select an independent entity for the Florida Department of Education to contract with in order to complete an independent verification of the 2014-2015 Florida Standards Assessment.
The law mandates that in selecting the independent entity, the panel must consider, at a minimum:
• The national reputation and length of establishment of the entity;
• The experience and expertise of the independent entity in validating such data; and
• The use of professional standards, codes, and guidelines that address applicable practices in the profession, such as the Standards for Educational and Psychological Testing.
The panel must select an independent entity no later than June 1, 2015. Upon selection of the independent entity, the Florida Department of Education must immediately contract with the entity to perform the verification, which must be completed by September 1, 2015.
