The Final Order was in response to a Petition for an emergency Variance from 55 West, filed February 29, 2014, and advertised on May 1, 2014 in Vol. 40, No. 85, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.7.4.1 ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code from the requirement for a minimum headroom clearance of 84 inches in the machine space within the machine room because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2014-112).

The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 3.11.3 ASME A17.3, 1996 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires upgrading the elevators with firefighters’ emergency operations because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2014-132).

that on May 21, 2014, St. Johns River Water Management District (“District”) issued a Final Order Granting Variance under Section 120.542, F.S. (SJRWMD FOR# 2014-16), to St. Johns County Utility Department (Petitioner). The District received the Petition for Variance on April 4, 2014, and an amended Petition for Variance on April 14, 2014 and published a notice of receipt in the Florida Administrative Weekly, Vol. 40, No. 75 on April 17, 2014. The District did not receive any public comment. The Final Order Granting Variance provides a variance from Rule 40C-3.517(3) of the Florida Administrative Code. This rule provides in pertinent part that water wells having a nominal casing size equal to or greater than four inches in outside diameter and obtaining water from a formation shall have a nominal two-inch thickness of grout sealing the annular space for the entire length of casing. The basis of the District’s decision to grant the variance is as follows: 1) requiring Petitioner to install a smaller diameter liner to achieve the required two-inch annular space would reduce the production capacity of the well and create a technological hardship 2) not granting the variance would require Petitioner to expend additional funds to properly abandon the existing well and construct a new well would creating a substantial financial hardship, and 3) the proposed alternative will not adversely affect the water resource.

Project Description: Interstate 95 (I-95) and the Palm Bay Parkway Southern Interchange
Project Development and Environment (PD&E) Study
from Babcock Street to Micco Road, Brevard County
The public hearing is held to give interested people the opportunity to express their views regarding future improvements at the interchange. The PD&E Study is being conducted to evaluate a new interchange along I-95, approximately 1.5 miles north of Micco Road. The study is also evaluating a multi-lane connector road connecting the proposed Palm Bay Parkway / St Johns Heritage Parkway from Babcock Street to Micco Road, a distance of approximately four (4) miles. These improvements are being evaluated to enhance social and economic needs, address future travel demand and provide for enhanced mobility in the City of Palm Bay and Southern Brevard County. A flyer with the agenda and other project-specific information will be distributed at the hearing. Additional information can also be obtained from the project website at www.palmbayinterchange.com
Additional right-of-way is required to produce the project. The proposed right-of-way is programmed for donation by the adjacent property owners. FDOT carries out a right-of-way acquisition and relocation program in accordance with section 339.09, Florida Statues and Uniform Relocation Assistance and Real Property Acquisition Act of 1970 as amended. The study team has identified potential encroachments on wetlands and floodplains and these areas may be given special consideration under Executive Orders 11990 and 11988.
