permanent variance from George and Cynthia Andrew seeking a variance from the rule provisions of Rules 62B-33.002(18) which defines “Eligible Structures”, 62B-33.002(43) which defines “Nonconforming Structures”, and 62B-33.0051(1)(a)1, F.A.C., which states that “[c]onstruction of armoring shall be authorized under the following conditions: 1. The proposed armoring is for the protection of an eligible structure.” The Petitioners seek a variance to construct a coastal armoring structure to protect their conforming home from additional erosion, and prevent pollution to the state waters as the home's sewer and water connection is located under the slab and is in imminent danger as a result of recent coastal storms in St. John's County. Additionally, an LP tank to service various gas appliances is buried along the north side of the dwelling in line with the seaward edge of the property. The proposed activities associated with the variance are located at 4588 Coastal Highway, St. Augustine, Florida. The petition has been assigned CCCL File # SJ-1217 AR V and OGC File #15-0294. No permit application has been submitted.

that on May 6, 2015, the Executive Director of the South Florida Water Management District (SFWMD or District) issued an Order Granting Variance under Section 120.542, Florida Statutes, (SFWMD 2015-025-DAO-ERP) to the Florida Department of Transportation – District IV (FDOT), concerning a project known as the I-95/I-595 Interchange Wet Armoring, located in Broward County, Florida, near the Fort Lauderdale-Hollywood International Airport; Section 21, Township 50 South, Range 42 East. The Petition for Variance (Application No. 150305-18) was received by the SFWMD on March 5, 2015. Notice of receipt of the Petition was published in the Florida Administrative Register, Vol. 41, Number 50, on March 13, 2015. No public comment was received. This Order provides a variance for the proposed modification of previously constructed and permitted wet ponds within the I-95/I-595 Interchange area. The particular criterion from which the variance is sought is found at Section 5.4.2(d) of the South Florida Water Management District Environmental Resource Permit Applicant’s Handbook Volume II, effective August 10, 2014, which is incorporated by reference in Paragraph 40E-4.091(1)(a) and Chapter 62-330, Fla. Admin. Code, pertaining to degree of side slopes acceptable for wet retention/detention and attenuation areas. This criterion provides, in general, that for purposes of public safety, water quality enhancement, and maintenance, all wet retention/detention areas shall be designed with side slopes no steeper than 4:1 (horizontal:vertical) from top of bank out to a minimum depth of two feet below the control elevation, or an equivalent substitute. The Order sets forth the basis of the SFWMD decision to grant the variance, as follows: 1) the variance is necessary to prevent a substantial hardship on FDOT; and 2) the purpose of the underlying rule has been achieved by other means.
