To incorporate requirements that were included in rule 6A-1.04513, F.A.C., Maintaining Auditable FTE Records, which will be repealed. The effect will be to consolidate requirements pertaining to educational program audits.

To add subsection (3) of rule 6A-1.006, F.A.C., Budget Amendments, and revise Forms ESE 348, Report of Financial Data to the Commissioner of Education and ESE 145, Superintendent’s Annual Financial Report. Subsections (1) and (2) of rule 6A-1.006, F.A.C., which will be repealed, will be consolidated with rule 6A-1.007, F.A.C. The effect will be to consolidate requirements pertaining to school district budgets and school district annual financial reports.

To move subsections (1) and (2) of rule 6A-1.006, F.A.C., Budget Amendments, to rule 6A-1.007, F.A.C., Execution of the Budget. Subsection (3) of rule 6A-1.006 will be moved to rule 6A-1.0071, Fiscal Reporting Dates and rule 6A-1.006 will be repealed. The effect will be to consolidate requirements pertaining to school district budgets.

To incorporate by reference an updated version (2016) of the publication Financial and Program Cost Accounting and Reporting for Florida Schools, 2015. Changes in law, accounting principles and district practices require periodic revision of this publication, which includes the chart of accounts. Changes in the publication and the chart of accounts include: (1) account modification and addition of elements of financial statements for presentation in accordance with the Governmental Accounting Standards Board principles; (2) modification of a revenue account title and definition to clarify reporting purposes; and (3) removal of an obsolete revenue account. Rules 6A-1.085, Basic Principle of Internal Fund Accounting, 6A-1.087, School Board Responsible for Internal Funds and 6A-1.091 Purchases from Internal Funds will be repealed due to duplicative guidance and principles which are incorporated by reference in rule 6A-1.001.

This Public Hearing is being conducted to give interested persons an opportunity to review the preferred bridge alternative under consideration and to express their views concerning the location, conceptual design, and social, economic, and environmental effects of the proposed improvements to the US 98/John Singletary Bridge (Bridge No. 160064) in Polk County, Florida. Financial Project ID No. 434886-1-22-01. This bridge was constructed in 1931 and has two 10-foot wide travel lanes and a 5.4-foot wide sidewalk on the north side. These dimensions are functionally obsolete. The need for the project is to provide a bridge built to current standards. The purpose of this project is to study ways to correct these identified deficiencies and maintain the connection between Downtown Fort Meade to the west and the City of Frostproof to the east, as US 98 serves as the main access road between the two cities. This project is also intended to enhance safety conditions as well as movement/access across the Peace River for motorists, pedestrians, and bicyclists, while minimizing potential impacts to the natural and human environments. The existing bridge (Bridge No. 160064) has been determined to be a significant historic bridge according to the Section 106 process of the National Historic Preservation Act (NHPA) of 1966 (36 CFR Part 800); however, based on an evaluation of all PD&E Study alternatives, it is not feasible to keep the historic bridge in place. Several mitigation options are being evaluated. The proposed improvements require the replacement of the National Register of Historic Places eligible US 98/John Singletary Bridge. As part of the project development process and in accordance with Section 4(f) of the Department of Transportation Act of 1966 and Section 106 of the NHPA, FDOT is seeking comments and input from the public, interested parties, and governmental agencies concerning the effects of the project on the activities, features, and attributes of this resource and the mitigation options under consideration for the proposed impacts. FDOT intends to make a programmatic Section 4(f) impact determination on this resource. At the conclusion of the presentation, attendees who complete a speaker’s card will be given the opportunity to make an oral statement that will become part of the public hearing record. Persons wishing to submit written statements or other exhibits, in place of or in addition to oral statements, may do so at the hearing or by sending them to Bill Hartmann, P.E., FDOT District One, P.O. Box 1249, Bartow, FL 33831. All exhibits or statements postmarked on or before May 29, 2017 will become part of the public hearing record. Marlin 1 LLC; On March 7, 2017 - Office of Financial Regulation (Consumer Finance) received a Petition for declaratory statement from Marlin 1 LLC. Marlin 1 LLC is contemplating starting a private lending company that would provide short-term loans not exceeding $25,000 at a interest rate of 18% per annum, to both individuals and small businesses. The petition seeks a declaratory statement from the Office on whether a consumer finance license pursuant to Chapter 516, Florida Statutes would be required.
On May 5, 2017, the Office issued a Final Order. The facts provided in the Petition are inadequate for the Office to make a determination whether Petitioner's proposed activities are lawful. Petitioner states that the loans would provide 'for a higher default rate of interest'. However, Petitioner does not state what this higher rate of interest would be, how long it would last, the loan amounts to which the interest rate would correlate, and what the maximum rate would be. Petitioner also mentions 'the imposition of late fees', but does not say how much these fees would be and under what specific conditions they would be imposed. Without this information, the Office cannot ascertain whether Petitioner's proposed conduct would be lawful. A declaratory statement is not available to Petitioner because the facts provided in the Petition are not clearly identified or delineated.

Square, Inc; On April 10, 2017 - Office of Financial Regulation (Consumer Finance) received a Petition for declaratory statement from Square, Inc. Petitioner is a licensed money transmitter under Chapter 560, Part II, Florida Statutes. Petitioner facilitates processing of tax and wage payments by U.S. businesses for their U.S. employees. Petitioner’s money transfer services are accessible solely via its Internet website and mobile device application. Petitioner does not provide money transfer services through physical locations or authorized vendor locations. The petition seeks a declaratory statement from the Office on whether requirements under Rule 69V-560.703(2)(c), Florida Administrative Code apply to the Petitioner.
On May 5, 2017, the Office issued a Final Order. the Office finds Petitioner is seeking a determination regarding its past or present and recurring activities. In the instant matter the Office cannot render a declaratory statement to Petitioner because Petitioner is seeking a determination as to acts which have already occurred, or which are now occurring. Any further analysis is unnecessary; and the Office therefore, makes no determination regarding the merits of Petitioner's arguments.
