Chapter 73B-10, Fla. Admin. Code (“F.A.C.”) sets forth procedures for the implementation of Florida’s Reemployment Assistance Program pursuant to Chapter 443, Florida Statutes. The Department seeks to update these rules through rule amendment. Specifically, the Department is amending Rule 73B-10.025, F.A.C., to remove an expiration date that no longer applies to a form. Rule 73B-10.026, F.A.C., is being amended to correct a statutory reference and remove unnecessary wording, while Rule 73B-10.027, F.A.C., is being amended to delete information about a procedure that is not performed. Rule 73B-10.028, F.A.C., is being amended to remove the requirement of the employer providing written requests for waivers, and 73B-10.031, F.A.C., changes the word “employees” to “unit.” Rule 73B-10.032, F.A.C., is being amended to correct a grammatical error, and Rule 73B-10.035, F.A.C., seeks to add an applicable statutory reference and delete a provision concerning benefit determinations which is unnecessary.

variance from Van Humphreys, Florida Department of Transportation, 1109 South Marion Avenue, Lake City, FL. Pursuant to Section 120.542, F.S. Petitioner is seeking a variance from paragraph 40B-4.3030(1)(e) and 40B-4.3030(7) F.A.C., as to New roads within a work of the district which at any point along the road, have a driving surface greater than one foot above adjacent natural ground elevation, or result in a net fill within the floodway and no fill material shall be placed above the natural grade of the ground except for minor amounts of fill which are less than or equal to 100 square feet of the cross-sectional area of the floodway. The vast majority of fill being placed in the floodplain is the result of the widening of substandard roadway lanes and shoulders to improve safety.
Since this project will be perpetually owned and maintained by a public entity, a permanent waiver is being requested. These rules are intended to set forth criteria for development activities within a Works of the District. The petition has been assigned ERP Number ERP-067-230260-1, CR 250 Bridge Replacement.

That on June 19, 2017, FDOT entered an Order Denying Variance from Rule 14-46.001, F.A.C. On March 24, 2017, Tampa Electric Company (TECO) filed a petition for an emergency variance from Rule 14-46.001, F.A.C., specifically the Utility Accommodation Manual (UAM) Section 4.8.3.3 Underground Crossings as incorporated into Rule 14-46.001. The variance request is to allow the placement of a gas line under a portion of I-295 to avoid a bridge structure. Notice of the Petition for Variance was published in the March 27, 2017, edition of the Florida Administrative Register. FDOT denied the variance, because TECO did not demonstrate that the strict application of Rule 14-46.001, F.A.C, would create a substantial hardship on TECO and that the customer could not be served without installation of a gas line crossing near or under a FDOT bridge or MSE wall, nor has TECO demonstrated that enforcement of Rule 14-46.001 violates principles of fairness.
