The Order, OGC #15-0145, CCCL file number SJ-1206 AR V, GRANTED the Petition for a permanent variance or waiver to Rules 62B-33.002(18), 62B-33.002(43), and 62B-33.0051(1)(a)1, FAC., based on a showing that Petitioners demonstrated that a strict application of the rules would result in substantial hardship to Petitioners or would violate principles of fairness because they would affect Petitioners differently than other similarly situated persons, and because Petitioners demonstrated that the purpose of the underlying statute will be or has been achieved by other means.

The petition requests a variance from the above referenced rule and, if granted, will allow Certified Nursing Assistants and Home Health Aides to satisfy the requirements of the rule by maintaining a current cardiopulmonary resuscitation (CPR) certification from an instructor that is approved to provide training by the American Safety & Health Institute (ASHI) or MEDIC First Aid® in addition to those entities listed in the rule. On June 8, 2015 the Division issued an order. The Final Order was in response to a Petition for a Variance from Palm Bay City Hall, filed April 14, 2015, and advertised on April 24, 2015 in Vol.41, No. 80, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.18.5.1, 2.20.1, 2.20.4, 2.20.5, and 2.20.9 ASME A17.1, 2005 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code from the requirement that the suspension be provided by steel wire ropes and that governor ropes be no less than 9.5mm to allow the use of a Schindler 3300 elevator system with 6mm governor ropes and non-circular elastomeric coated steel suspension members because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2015-100).

The petition, dated May 18, 2015, requests a variance or waiver of the requirement that the VPK provider utilize the observational instrument known as Teaching Strategies Gold, and requests that the VPK provider be permitted to utilize the HighScope COR Advantage assessment. The petitioner is Redlands Christian Migrant Association. The petition also seeks a waiver or variance from an associated rule adopted by the Office of Early Learning, Rule 6M-1.09433(1)(b), Voluntary Prekindergarten (VPK) Pre- and Post-Assessments.

To receive public comments on draft nutrient total maximum daily load (TMDL) reports for impaired waters in the Withlacoochee River Basin, to be adopted in Rule 62-304.640, F.A.C. These nutrient TMDLs, if adopted, will constitute site specific numeric interpretations of the narrative nutrient criterion set forth in paragraph 62-302.530(47)(b), F.A.C., that would replace the otherwise applicable numeric nutrient criteria in subsection 62-302.531(2) for these particular waters. The TMDLs to be presented at the public workshop include TMDLs for Lake Juliana (WBID 1484B) and Mud Lake (WBID 1467).
The draft TMDL documents for these impaired waters will be placed on the Department’s TMDL website (http://www.dep.state.fl.us/water/tmdl/) by June 11, 2015 and will be provided upon request to interested parties by mail or via e-mail distribution. The Department will accept written comments on the draft TMDLs, as well as the establishment of these nutrient TMDLs as site specific interpretations of the narrative nutrient criterion, through July 13, 2015. Approval for the Department to publish a Notice of Proposed Rule that schedules a public hearing on proposed new Rule 12D-8.0065 (Transfer of Homestead Assessment Difference; “Portability”; Sworn Statement Required; Denials; Late Applications) and proposed revisions to Rule 12D-16.002 (Index to Forms) to adopt proposed Form DR-501TS (Designation of Ownership Shares of Abandoned Homestead). The Department held a rule development workshop on these proposed rules on February 24, 2015 at which the public offered comments and suggestions. This workshop was noticed in the February 2, 2015 edition (Vol. 41, No. 21, pp. 571-573) of the Florida Administrative Register. A second workshop was held on May 19, 2015.
