Chapter 62-780, F.A.C., was adopted in 2005 and has not been substantially updated on a technical basis since then. In the intervening time, much has been learned with regard to applying Risk-Based Corrective Action (RBCA) principles to contaminated site management and closure. The rule chapter will be modernized to incorporate these “lessons learned” and to facilitate contaminated site closure. In addition, new techniques and approaches have been developed to support RBCA, but the rule chapter is silent, ambiguous or implicitly prohibits these advancements. Finally, a number of inconsistencies or incongruities have been uncovered within the rule chapter, and these will be corrected.
Specific topics to be addressed include evaluation of Incremental Sampling Methodology, revision of determination of leachability, and the use and application of apportionment.
This rule making is planned to run concurrently with rule making for Chapter 62-777, F.A.C. "Contaminated Site Cleanup Criteria".

Since Chapter 62-777 was adopted in 2005 there have been many changes with regard to how to calculate appropriate risk-based cleanup target levels both in terms of the methods of calculation and the parameters used in the calculations. These developments lead to improved derivation of the appropriate cleanup target levels and provide the correct degree of protection to human health and the environment. These new methods also reduce the amount of conservatism in some previous estimates to suitable levels thereby providing sufficient protectiveness while minimizing potential cleanup costs. The department is proposing to review and update the method(s) for establishing cleanup target levels, the parameter values used, and develop updated cleanup target levels. Note that tables 1-6 and figures 1-10 in 62-777, F.A.C. will also be updated. This update to the method(s) and values is planned to run concurrently with the rule making for Chapter 62-780, F.A.C.

This public workshop is for interested stakeholders to discuss with the Department issues related to development of nutrient and dissolved oxygen total maximum daily loads (TMDLs) for Lake Talquin in the Ochlockonee River basin. The workshop will provide an opportunity for the Department to present and respond to the public comments received since the January 27, 2015 meeting on TMDL modeling, discuss potential TMDL target setting approach, and outline the next steps. Furthermore, the Department intends for the nutrient TMDLs to constitute site specific numeric interpretations of the narrative nutrient criterion set forth in paragraph 62-302.530(47)(b), F.A.C., that will supersede the otherwise applicable numeric nutrient criteria in rule 62-302.531, F.A.C., for the particular surface water segment.
