This notice of rule development is being reposted to correct an error in the original notice posted on June 9, 2014, Vol. 40/111. The error is in the second to last sentence under the “Place” section where the month was incorrectly listed as July 25 and July 27 and should have been listed as June 25 and June 27 as correctly posted in the “Date and Time” section.
The purpose of this rule development is to update provisions in the rule due to statutory changes, rule changes and for clarity. Proposed changes include: definitions of terms used in the rule; update of specifications for the uniform core curricula; modification of processes for initial request and approval of teacher preparation programs; update criteria and data submitted for review as part of the institution’s or district’s annual program evaluation plan and for the general public; and revision of criteria for continued approval of programs to be based upon specified measures of program and program completer performance, including the program review process, timelines, and performance level targets for each of the continued approval criteria.

The purpose of this rule development is to update the Postsecondary Industry Certification Funding List. The requirement for the adoption by the State Board of Education was created in Chapter 2013-27, Laws of Florida. The effect of this rule is to update the postsecondary funding list for the implementation of performance funding for districts and colleges as specified in Sections 1011.80 and 1011.81, Florida Statutes. From this approved list, the Chancellors of the Division of Career and Adult Education and the Florida College System will identify industry certifications eligible for funding the areas targeted in the General Appropriations Act.

This rulemaking will address changes that the Florida Legislature made during the 2011, 2013 and 2014 legislative sessions to Sections 290.0411 through 290.0475, Florida Statutes. The rulemaking will also resolve conflicts between the rule and other sections of Florida Statutes. Finally, the rulemaking will make it easier for local governments to understand the application process, find information related to economic development grants, and know what is required of them if they receive funding.

The Department is revising subsection 62-621.300(4), F.A.C., the existing Stormwater NPDES Construction Generic Permit (CGP) to be consistent with the United States Environmental Protection Agency's rule revisions adopted 2012. The Department is also revising subsection 62-621.300(2), F.A.C., the existing Industrial Wastewater NPDES Generic Permit for the Discharge of Ground Water from Dewatering Operations (dewatering). The rule is being revised to eliminate permitting duplication for sites covered under the CGP that also have dewatering operations which will no longer need separate coverage under the industrial wastewater generic permits. Further, the revised dewatering generic permit is expected to reduce monitoring costs by approximately $950.00 on the first year of coverage alone, per facility, by eliminating initial screening and replacing effluent monitoring with site specific control measures (Best Management Practices). The new sediment control measures are more effective at minimizing or eliminating pollutant discharges from dewatering operations to surface waters of the State.

The purpose of this rulemaking is to create a consolidated, consistent process for petitioning for variances and waivers from year-round conservation measures and water shortage orders. This rulemaking will promote consistency of terms throughout 40D, F.A.C., and Florida Statutes, will delete obsolete provisions, and will conform District rules to Florida Statutes. This rulemaking will improve rule clarity.

The subject of this Petition is an interpretation of Section 633.322(2), Florida Statutes. Specifically, the petitioner has asked whether a special district may act as a permitting authority and, if so, whether the county and municipality sharing the geographical space of the special district may also assert permitting authority. The Division of State Fire Marshal determined Chapter 633 does not impose any restrictions or limitations on the permitting authority of a special district, county, or municipality. Therefore there is no limitation regarding duplicate permitting in Chapter 633.
