That on May 25, 2015, pursuant to Section 120.542, F.S., the Bureau of Radiation Control has issued an order.
The Order grants a variance from subparagraph 64E-5.502(1)(a)6., F.A.C., for the Brevard County Sheriff’s Office. The petition for a variance was received by the Department on March 16, 2015. Notice of receipt of the petition was published in the Florida Administrative Register on March 25, 2015. Subparagraph 64E-5.502(1)(a)6., F.A.C., prohibits individuals from being exposed to radiation from an x-ray machine for training, demonstration or other purposes unless there are also medical requirements and a proper prescription has been provided. The Brevard County Sheriff’s Office has been granted a variance to subparagraph 64E-5.502(1)(a)6., F.A.C., allowing the intentional exposure of individuals to ionizing radiation for the specific purpose of screening inmates at the Brevard County Sheriff’s Office and under the condition that the machine or any future replacement machines and their use meet the standards found in ANSI/HPS N43.17-2009. The variance is in effect until such time as the Department promulgates rules specific to ionizing radiation machines for personnel security purposes.

SP Crossings, LLC, requesting a waiver from the requirements of paragraph 67-21.003(8)(j), F.A.C., which would allow it to amend an application for Housing Tax Credits to decrease the Total Set-Aside Percentage from 100% to 84%. This Notice amends the original F.A.R notice 41/81 published April 27, 2015 regarding SP Crossings Variance and Waiver.

variance or waiver of Rule 64B19-11.005, F.A.C., filed by S. Kathleen Krach, Ph.D., regarding the requirement that 2,000 hours of supervised experience for licensure be done under a supervisor who is either a licensed Florida psychologist in good standing with the Board, or a doctoral-level psychologist licensed in good standing in another state or United States territory providing supervision for licensure in that state or territory. The Board will consider this petition at its meeting currently scheduled for July 17, 2015.

David Brancati, OD, filed a Petition for Variance or Waiver on February 12, 2015 – published February 17, 2015, in Vol. 41, No. 32, of the Florida Administrative Register – regarding Rule 64B13-5.001(2), F.A.C., which requires that a licensed optometrist provide 30 hours of continuing education, six of which must be approved as transcript quality courses each biennium. The Board considered the Petition at a duly-noticed telephonic, public meeting held on February 27, 2015.
The Board’s Order, filed March 11, 2015, granted the Petition, finding that the purpose of the underlying statute, §463.007, F.S., has been achieved and application of Rule 64B14-5.001(2), F.A.C., would create a substantial hardship and violate the principles of fairness under these specific circumstances.
