On June 5, 2018 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Subparagraph 3-305.11(A)(2), 2009 FDA Food Code, Section 3-305.14, 2009 FDA Food Code, Section 6-202.15, 2009 FDA Food Code, Section 6-202.16, 2009 FDA Food Code, Paragraph 61C-4.010(1), Florida Administrative Code, and Paragraph 61C-4.010(6), Florida Administrative Code from Victoria's Catering 1 located in Orlando. The above referenced F.A.C. addresses the requirement for proper handling and dispensing of food. They are requesting to dispense bulk time/temperature control for safety foods from an open air mobile food dispensing vehicle.
The Petition for this variance was published in Vol. 44/110 on June 6, 2018. The Order for this Petition was signed and approved on June 26, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring that each pan within the steam table is properly covered with an individual lid; the steam table is enclosed within a cabinet with tight-fitting doors, and is protected by an air curtain installed and operated according to the manufacturer’s specifications that protects against flying vermin or other environmental contaminants; all steam table foods must be properly reheated for hot holding at approved commissaries and held hot at the proper minimum temperature per the parameters of the currently adopted FDA Food Code; and steam table food is to be dispensed by the operator with no customer self-service. The Petitioner shall also strictly adhere to the operating procedures and copies of the variance and operating procedures are to be present on the MFDV during all periods of operation.

Petitioner sought to take an online acupuncture CE course in satisfaction of the rules requirements. The Board considered the instant Petition as a duly-noted public meeting held on May 18, 2018, in Kissimmee, Florida. The Board’s Order, filed on June 13, 2018, denied the Petition finding that Petitioner had failed to demonstrate how compliance with Rule 64B2-13.004, F.A.C., would pose an undue hardship or violate the principles of fairness.

GENERAL SUBJECT MATTER TO BE CONSIDERED: To obtain public comments on the draft injection well permit for Miami-Dade Water and Sewer Department, who applied on October 5, 2017, for a permit to construct injection wells (File No. 061787-043-045-UC/1M, WACS ID No. 57046). The project is located at the South District Wastewater Treatment Plant (WWTP), 8950 Southwest 232nd Street, Cutler Bay, Florida 33190, in Miami-Dade County, and will consist of three new non-hazardous Class I injection wells, IW-18, IW-19, and IW-20, and operationally test those wells for the disposal of secondary treated municipal effluent which has received high-level disinfection from the Miami-Dade South District WWTP. Wells IW-18, IW-19, and IW-20 are to be constructed with a 24-inch steel diameter casing set to 2,400 feet below land surface (bls) and total depth of 3,200 feet bls completed into the Oldsmar Formation. The maximum injection volume for each injection well is to be 18.65 million gallons per day (MGD). Three single-zone monitor wells will be constructed for this project.
ALSO, TO BE CONSIDERED: To obtain public comments on the draft injection well permit for Miami-Dade Water and Sewer Authority Department, who applied on November 17, 2017, for a permit to construct injection wells (File No. 0317749-006-012-UC/1M, WACS ID No. 101237). The project is located at the Miami-Dade Central District WWTP (MDCDWWTP), 3989 Rickenbacker Causeway, Virginia Key, Florida 33149, in Miami-Dade County, and will consist of seven new non-hazardous Class I injection wells (CDIW-3 through CDIW-9) and associated monitor wells (CDMW-2 through CDMW-5), and operationally test those wells for the disposal of secondary treated domestic wastewater with high-level disinfection from the MDCDWWTP. The maximum injection rate for each injection well will not exceed 18.65 MGD. The injection wells are proposed to be constructed with a 24-inch diameter casing set to 2,650 feet bls and total depth of 3,200 feet bls. Sun Coast Consulting Services.; The petition seeks a declaratory statement from the Office on (1) whether having substantially less than twelve (12) trusts, and never having more than twelve (12) trusts would be considered "de minimis" under Sec. 658.12(20), Florida Statutes; and (2) whether not having performed any of the fiduciary functions prohibited under Sec. 660.41, Florida Statutes, Petitioner is not barred from being a Trustee on a trust solely on the basis that it is an incorporated entity; and/or (3) that Petitioner is not required to register because its Trustee business is "de mininis" and thus not barred from acting as a Trustee at this time.

Nicholas James Kirton; The Notice of Petition for Declaratory Statement was published in Volume 44, No. 48, of the March 9, 2018, Florida Administrative Register. The Board reviewed the Petition as its meeting held on May 18, 2018. The Board’s Order, filed on June 13, 2018, denies the Petition for Declaratory Statement based on the fact that the petition fails to identify exactly what statement Petitioner requests the Board issue. Petitioner cites one sub-paragraph of section 460.406, F.S.; the statute contains additional licensure criteria in other subsections. The Board also found that the petition is legally insufficient and therefore declined to answer the petition.
