The recently enacted Section 456.0301, F.S., requires the Board to approve continuing education courses for those physicians who prescribe controlled substances. The proposed rule amendments set forth the entities approved by the Board to provide the prescribing controlled substances course for licensure renewal and add additional entities to the recent new rule requiring the course for prescribers prior to January 31, 2019.

The purpose and effect of this rule development is to establish definitions, update current versions of federal regulations, update the current permitting structure to a risk-based system, consolidate the requirements of Chapter 5K-9, F.A.C., for vended water machines into Chapter 5K-4, F.A.C., and to include guidelines for administrative penalties.

NOAA Fisheries approved a rule increasing the commercial minimum size limit from 22 to 24 inches total length for gag grouper in federal waters of the Gulf of Mexico (see 50 C.F.R. §622.37(b)(1) as of July 23, 2018). This change was requested by Florida commercial grouper fishermen and will make the Gulf commercial size limit consistent with the size limit in the Atlantic Ocean. The purpose of these rules is to achieve consistency between the Commission’s gag grouper regulations and regulations in federal waters of the Gulf of Mexico.
The effect of the rule amendment is that state and federal regulations can be applied more consistently to recreational fishing activity for gag grouper in the Gulf of Mexico. In addition, a 24-inch total length commercial minimum size limit for gag grouper in state waters of the Gulf of Mexico would match the current size limit for recreational harvest, as well as for commercial harvest in state and federal waters of the Atlantic Ocean, making regulations more consistent across both coasts which would improve enforceability and understanding of rules.
Rule 68B-14.0035, F.A.C. (Size Limits: Amberjacks, Black Sea Bass, Gray Triggerfish, Grouper, Hogfish, Red Porgy, Snapper) would be amended to specify a 24-inch total length minimum size limit for gag grouper commercially harvested in the Gulf of Mexico.

of the issuance of an Order regarding the Petition for Variance or Waiver, filed on August 14, 2017, by Aaron Taylor, D.C. The Notice of Petition for Variance or Waiver was published in Vol. 43, No. 164, of the August 23, 2017, Florida Administrative Register. Petitioner sought a variance from or a waiver of Rule 64B2-13.004(3), F.A.C, specifically waiving the criteria for approval of an online continuing education course. The Board considered the instant Petition at a duly-noticed public meeting held on September 25, 2017, by telephone conference call. The Board’s Order, filed on June 8, 2018, denied the petition as moot because the Board approved the continuing education course in another proceeding.

On June 18, 2018 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from Miss Saigon Deli LLC located in Titusville. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 44/119 on June 19, 2018. The Order for this Petition was signed and approved on June 27, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Central Square Salon & Barber Shop (3470 S Hopkins Ave Titusville, FL 32780), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Miss Saigon Deli (Miss Saigon Deli LLC) and/or Central Square Salon & Barber Shop (Allan T. Griffith) changes, an updated signed agreement for use of the bathroom facilities will be required immediately.

a variance from subsection 14-10.004(7)(d), F.A.C., which directs that no sign permit shall be issued for a sign to be located outside the boundaries of an incorporated municipality and within 500 feet of an interchange, intersection at grade, or rest area on the interstate. The request from Carter-Pritchett Advertising, Inc., is a result of the denial of two permit applications to relocate existing signs due to expansion of the interstate.
