Church of Scientology West Coast Building located at 118 N. Ft. Harrison Ave, Clearwater, FL. Petitioner seeks an emergency variance of the requirements of Sections 1.2, 2.2.4, 2.6.3, 2.7.4, 3.4.4, 3.9.2, 3.10.3, and 3.11.1, ASME A17.3, 1996 edition, as adopted by 61C-5.001(1), Florida Administrative Code that requires the upgrading the elevators which poses a significant economic/financial hardship and diminishes the historic value of the building. On June 10, 2016 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Nokomo’s Sunset Hut located in Nokomis. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink.
The Petition for this variance was published in Vol. 42/118 on June 17, 2016. The Order for this Petition was signed and approved on June 27, 2016. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

Code, which governs the placement of permanent and /or semi-permanent above-ground structures within 40 feet of the top of the canal bank within Works and Lands of the District.

The Final Order was in response to a Petition for an emergency permanent Variance from Bank of America, filed May 12, 2016, and advertised on May 16, 2016, in Vol. 42, No. 95, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 2.10.2.1, 2.4.6.2(c), 2.4.1.5(c), and 2.15.9.2, ASME A17.1b, 2009 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code. Petitioner has been granted a variance to use a folding car top handrail and retractable toe guard. (VW 2016-120).
