- Petitions and Dispositions Regarding Rule Variance or Waiver (2)

On May 21, 2018 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from SVRK Enterprises LLC located in Destin. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink and the three compartment sink.
The Petition for this variance was published in Vol. 44/100 on May 22, 2018. The Order for this Petition was signed and approved on May 31, 2018. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink and the three compartment sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink and the three compartment sink is provided with hot and cold running water under pressure, and that the handwash sink is provided with soap, an approved hand drying device and a handwashing sign.

To obtain public comments on the draft injection well permit for Miami-Dade Water and Sewer Authority Department, who applied on October 5, 2017, for a permit to operate an injection well (File No. 061787-043-045-UC/1M, WACS ID No. 57046). The project is located at the South District Wastewater Treatment Plant (WWTP), 8950 Southwest 232nd Street, Cutler Bay, Florida 33190, in Miami-Dade County, and will consist of three new non-hazardous Class I injection wells, IW-18, IW-19, and IW-20, and operationally test those wells for the disposal of secondary treated municipal effluent which has received high-level disinfection from the Miami-Dade South District WWTP. Wells IW-18, IW-19, and IW-20 are to be constructed with a 24-inch steel diameter casing set to 2,400 feet below land surface (bls) and total depth of 3,200 feet bls completed into the Oldsmar Formation. The maximum injection volume for each injection well is to be 18.65 million gallons per day (MGD). Three single-zone monitor wells, FA-18, FA-19, and FA-20, will be constructed for this project. The monitor interval for monitor wells FA-18, FA-19, and FA-20 is from 980 to 1,090 feet bls. Under this permit all zones of existing monitor wells BZ-1, FA-10, FA-15, and FA-16 and the lower zones of FA-1, FA-3, and FA-4 are to be plugged and abandoned. Single-zone monitor wells FA-1, FA-3, and FA-14 and regional dual-zone monitor well CHI, along with the three-new single-zone monitor wells FA-18, FA-19, and FA-20 are proposed for monitoring this site.

The maximum injection rate for each injection well will not exceed 18.65 MGD. The injection wells are proposed to be constructed with a 24-inch diameter casing set to 2,650 feet bls and total depth of 3,200 feet bls. The dual-zone monitor wells are proposed to be completed in the Floridan aquifer from 1,125 to 1,175 feet bls and from 1,650 to 1,700 feet bls.; Wednesday, June 27, 2018, at 10:00 a.m. to noon.; Miami-Dade Water and Sewer Department, located at 13071 Southwest 38 Avenue, Miami, Florida 33146.
