The Notice of Petition for Variance and Waiver was published in Volume 39, No. 52, of the March 15, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on March 22, 2013. The Petitioner was seeking a permanent variance or waiver of Rule 64B19-11.005, Florida Administrative Code, with regards to the requirement that applicants for licensure complete at least 2,000 hours of doctoral experience under a supervisor whose supervision comports with this rule.
The Board=s Order, filed on March 28, 2013, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that she meets the purpose of the underlying statute. Petitioner has established that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. The Petitioner has established that the Board’s application of Rule 64B19-11.005, Florida Administrative Code, to the Petitioner’s circumstances would violate the principles of fairness or would impose a substantial hardship. The Petitioner has provided sufficient evidence of attempts to contact the director or an APA accredited doctoral program in psychology to demonstrate that application of the rule to her circumstances would violate principles of fairness or would impose a substantial hardship. Further, Petitioner has demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness. Accordingly, The Board finds that the Petition demonstrates that the purpose of the underlying statute has been or will be achieved and that application of the rule imposes a substantial hardship or violates principles of fairness.

Petitioner has not demonstrated that she meets the purpose of the underlying statute. Further, Petitioner has not demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness as Petitioner admits, she is requesting from the portion of the rule that as amended out of the rule in October 2011and the Board cannot vary or waive a portion o f a rule that no longer exists. On the contrary, application and variance or waiver of a portion of the rule that no longer exists would violate the principles of fairness.

The Final Order is regarding receipt of a Petition for Variance and Waiver, filed on April 25, 2013, from Petitioner Brittani Johnson. The Petition does not identify the administrative rule from which a variance or waiver is sought. The Board considered the Petition at a duly-noticed telephonic meeting held on March 22, 2013. The Petitioner requested the Board’s interpretation of Sections 490.003(4)(a)9), Florida Statues, with regards to providing psychological services and that services can be provided without regards to the place of service.
The Board’s Order, filed on April 16, 2013 grants the declaratory statement. The Board’s response to this Petition is based solely on the Board’s application of the narrow, factual circumstances outlined in the Petition to the pertinent statutory provision set forth in the Petition. However, Petitioner appears to be requesting the Board’s interpretation of Section 490.003, Florida Statutes, as to whether the provision of assessment and consultation services to FCCC residents, legal counsel (e.g., Public Defender's office) retained by residents of the FCCC, or to the State's Attorney's Office would, in any way, constitute a harmful multiple relationship, conflict of interest, or any other breach of professional ethics, given the former role as FCCC Clinical Director.

The Petitioner requested the Board’s interpretation of Rule 64B19-19.003, Florida Administrative Code, regarding the maintenance and retention of records when a psychologist is independently contracting with a psychology practice.
The Board’s Order, filed on March 19, 2013, denies the declaratory statement. The Board determined the Petition is requesting for clarification of the statutory provision and rules to determine conduct that has already occurred. This type of clarification is not appropriate for determination by declaratory statement. Furthermore, it is the Board’s opinion that section 490.148, F.S., and rules 64B19-19.003, 64B19-19.005, and 64B19-19.006, F.A.C. are not ambiguous and declines to clarify the statute and rules.
