- Petitions and Dispositions Regarding Rule Variance or Waiver (5)

On May 19, 2017 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(2)(a), Florida Administrative Code, Paragraph 61C-4.010(7), Florida Administrative Code, Paragraph 61C-4.010(6), Florida Administrative Code, and Section 6-402.11, 2009 FDA Food Code, Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Section 5-203.13, 2009 FDA Food Code from Body Sadeh Group Inc. located in Panama City Beach. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers and employees and the requirement that at least one service sink is provided for the cleaning of mops or similar cleaning tools and the disposal of mop water. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers and employees and to utilize a mopsink located within a nearby business under a different ownership.
The Petition for this variance was published in Vol. 43/99 on May 22, 2017. The Order for this Petition was signed and approved on June 1, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within Mango Beach Tattoo, Piercing & Pipes Inc. are maintained in a clean and sanitary manner and are provided with hot and cold running water under pressure, soap, approved hand drying devices, handwash sign and are available during all hours of operation and that the mop sink is maintained in a clean and sanitary manner and is provided with hot and cold running water under pressure. The Petitioner shall also ensure directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of Monkey Licks (Body Sadeh Group Inc.) or Mango Beach Tattoo, Piercing & Pipes Inc. changes, an updated signed agreement for use of the bathroom facilities and the mop sink will be required immediately.

On May 24, 2017 the Division of Hotels and Restaurants received a Petition for an Emergency Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Chef Pat's Cuisines Inc. located in Lauderdale Lakes. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the handwash sink.
The Petition for this variance was published in Vol. 43/102 on May 25, 2017. The Order for this Petition was signed and approved on June 1, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the wastewater holding tank for the handwash sink is emptied at a frequency as to not create a sanitary nuisance; and potable water provided must come from an approved source and be protected from contamination during handling. The Petitioner shall also ensure that the handwash sink is provided with hot and cold running water under pressure, soap, an approved hand drying device and a handwashing sign.

- Notices of Petitions and Dispositions Regarding Declaratory Stat (5)

Choice Plus LLC; The petitioner requested the Department issue a declaration describing what form of judicial process and documentation the Department deems is necessary for a creditor to be considered an "owner" under chapter 717, Florida Statutes (2016), and as articulated in Martin Young Private Investigative Agency, Inc. v. Department of Banking and Finance, 659 So.2d 410 (Fla. 1st DCA 1995). The Department’s Final Order entered on May 31, 2017, declined to issue a declaratory statement because the petition asks for the Department’s interpretation of an appellate court decision and, therefore, cannot support the rendition of a declaratory statement, requires a response of such a general and consistent nature as to meet the definition of a rule, and makes allegations that are not a “particular set of circumstances” necessary to requesting a declaratory statement.
-

Brown Brothers Harriman & Co; The Office of Financial Regulation (Financial Institutions/Securities) received a petition for declaratory statement from Brown Brothers Harriman & Co. The petition sought a declaratory statement from the Office on whether Petitioner, as a bank authorized to do business in the State of Florida, BBH is exempt from registration with the Office as a dealer pursuant to Chapter 517, Florida Statutes ("Chapter 517"). On June 2, 2017, the Office issued a Final Order. Petitioner is a "bank" as that term is used and referenced in Chapter 517, FS; and Petitioner qualifies for the exemptions from registration as a "dealer" as provided in section 517.021(6)(b)2., FS, and as an investment advisor as provided in section 517.021(14)(b)3, FS and therefore, Petitioner is not required to obtain broker-dealer or investment adviser registration to engage in the activities authorized for a dealer or investment adviser in the state of Florida.
