that on May 31, 2013, pursuant to Section 120.542, F.S., the Bureau of Radiation Control has issued an order.
The Order grants a variance from subparagraph 64E-5.502(1)(a)6., F.A.C., for the Sarasota County Sheriff’s Office. The petition for a variance was received by the Department on March 14, 2013. Notice of receipt of the petition was published in the Florida Administrative Register on March 29, 2013. Subparagraph 64E-5.502(1)(a)6., F.A.C., prohibits individuals from being exposed to radiation from an x-ray machine for training, demonstration or other purposes unless there are also medical requirements and a proper prescription has been provided. The Sarasota County Sheriff’s Office has been granted a variance to subparagraph 64E-5.502(1)(a)6., F.A.C., allowing the intentional exposure of individuals to ionizing radiation for the specific purpose of screening inmates at the Sarasota County Sheriff’s Office and under the condition that the machine or any future machines and their use meet the standards found in ANSI/HPS N43.17-2009. The variance is in effect until such time as the Department promulgates rules specific to ionizing radiation machines for personnel security purposes.

The petition seeks relief form Rule 40E-6.011(4) and (6), Fla. Admin. Code, which governs the use of the District’s rights of way for placement of above ground facilities within 40 feet from the top of bank within Works or Lands of the District.

On June 6, 2013, the Department of Financial Services, Division of Legal Services, issued a Final Order Denying Petition for Variance and Waiver, Case Number 127579-12-AG. The Final Order is regarding receipt of a Petition for Variance and Waiver, filed on April 22, 2013, from Petitioner Gus Jones. The Petition does not identify the administrative rule from which a variance or waiver is sought. The Notice of Petition for Variance and Waiver was published in Volume 39, No. 81, April 25, 2013, edition of Florida Administrative Register. The Final Order Denying Petition for Variance found that the Petition does not identify the administrative rule from which a variance or waiver is sought, does not comply with statutory requirements, and that the general relief sought is not available to the Petitioner. No comments were received.

The Florida Department of Transportation has initiated the Polk Rail Study to identify the best solutions for regional freight movement through Polk County while minimizing community and environmental impacts. The public workshop will be held from 5 p.m. to 7 p.m. in an open house format allowing interested people an opportunity to view the displays and discuss the project with project team representatives. A brief presentation will begin at 6 p.m. During the workshop, attendees can also visit interactive exhibits such as a noise booth to listen to sound level samples of trains, motorcycles, and other similar examples. Participants can also stop by a computer lab to access the project’s website and virtual town hall and join the discussion online.
In the event that a hurricane warning is issued for June 18th, the workshop will be postponed and will be held on the alternative date of Wednesday, July 24, 2013 at the same time and location.
