On June 20, 2017 the Division of Hotels and Restaurants received a Petition for a Routine Variance for Paragraph 61C-4.010(7) Florida Administrative Code and Paragraph 61C-4.010(6), Florida Administrative Code from MP Food Services LLC located in Orlando. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Petition for this variance was published in Vol. 43/120 on June 21, 2017. The Order for this Petition was signed and approved on July 7, 2017. After a complete review of the variance request, the Division finds that the application of this Rule will create a financial hardship to the food service establishment. Furthermore, the Division finds that the Petitioner meets the burden of demonstrating that the underlying statute has been achieved by the Petitioner ensuring the bathrooms located within The Purple Orchid Cafe (9318 E Colonial Dr. A9, Orlando, FL 32817), are maintained in a clean and sanitary manner and are provided with cold running water under pressure, soap, approved hand drying devices, and are available during all hours of operation. The Petitioner shall also ensure that directional signage is installed within or outside the establishment clearly stating the location of the bathrooms. If the ownership of MP Food Services LLC (Almendra's Kitchen) and/or The Purple Orchid Cafe (The Purple Orchid Café LLC) changes, an updated signed agreement for use of the bathroom facilities will be required immediately

SUMMARY: The state of Florida is required to submit an Action Plan to the U. S. Department of Housing and Urban Development (HUD) in order to receive federal funding from that agency. The Action Plan must cover the grant programs funded by HUD. Grant programs included in the Action Plan are administered by four state agencies: the Florida Small Cities Community Development Block Grant (CDBG) by the Department of Economic Opportunity; the Emergency Solutions Grant (ESG) by the Department of Children and Families; the Home Investment Partnership (HOME) and National Housing Trust Fund (HTF) by the Florida Housing Finance Corporation and the Housing Opportunities for Persons with Aids (HOPWA) by the Department of Health. The Action Plan must specify the manner in which the funds will be distributed to eligible applicants.
ACTION TO BE TAKEN: At the workgroup meeting to be held on July 17, 2017, staff from the CDBG, ESG, HOME, HTF and HOPWA Programs will provide an overview of the programs and answer questions. Interested parties are encouraged to attend. Another public meeting will be conducted on July 31, 2017, to review and accept comments on the drafted Action Plan. The draft of the Action Plan will also be posted on the Department’s website: http://www.floridajobs.org/Annual-Action-Plan. The 14-day comment period on the drafted Action Plan will commence on July 17, 2017, and will conclude July 31, 2017.

This is a meeting of an Advisory Council required by Florida Statute 381.84. The council meets four times per year to provide advice to the Department of Health relating to the Comprehensive Tobacco Education and Use Prevention Program. Roger D. Casey on behalf of Casey Electric Inc,; The Notice of Petition for Declaratory Statement was published in Volume 43, No. 04, of the January 6, 2017, Florida Administrative Register. Petitioner ask the Board for Clarification of s. 489.105(3)(i), Fla. Stat., specifically whether a certified mechanical contractor is authorized to perform gas piping to equipment or appliances exterior of a building as well as inside. The Petitioner’s request for clarification appears to apply to past practice and a petition for declaratory statement is not appropriate when it relates to the past practice. The Petitioner’s petition does not apply only to Petitioner’s particular set of circumstances, but rather is a matter of general applicability. It is the Board’s opinion that s. 489.105(3)(i), Fla. Stat. is not ambiguous, and declines to clarify the statute. The Board’s Order, filed on June 29, 2017, declines to issue a declaratory statement in this matter.

William Cark Clifford Cryer; The Notice of Petition for Declaratory Statement was published in Volume 43, No. 59, of the March 27, 2017, Florida Administrative Register. Petitioner asks the Board whether an underground utility and excavation contractor license, as its scope is defined in s. 489.105(3)(n), Fla. Stat., is required when the only work performed is the installation of casing pipe or conduit accomplished through a trenchless technology technique such as directional drilling, auger boring, jacking and boring, micro tunneling, pipe ramming or pilot tube guided boring. The Board considered the Petition at its meeting held on April 14, 2017, in Altamonte Springs, Florida. The Board’s Order, filed on June 29, 2017, answers the question in the affirmative. The applicability of this Declaratory Statement is limited to the set of facts incorporated in the Order.
