The purpose and effect of this rulemaking is to incorporate by reference the Well Construction Permitting Agreements Between the Southwest Florida Water Management District and Sarasota County, Manatee County, and the Florida Department of Health in Marion County, which were recently approved by the District’s Governing Board. These Agreements memorialize and continue the long-standing delegation by the District of the well construction permitting program in Sarasota, Manatee, and Marion Counties. The Agreements are effective June 1, 2016, and expire May 31, 2021, unless terminated earlier. The amendment of this rule to incorporate these Agreements by reference maintains the regulatory status quo for well construction permitting in Sarasota, Manatee and Marion Counties.

- Petitions and Dispositions Regarding Rule Variance or Waiver (6)

On July 11, 2016, the Department received a request withdrawing the Petition for variance from Seminole Electric Co, filed May 2, 2016, and advertised on May 5, 2016, in Vol. 42 No. 88 of the Florida Administrative Register. The Petition for variance requested a variance from Rule 4.1.16, ASME A17.1, 2010 edition, as adopted by 61C-5.001(1)(a), Florida Administrative Code that requires upgrading the elevators for firefighters’ emergency operations. The Department of Business and Professional Regulation, Division of Hotels and Restaurants, Bureau of Elevator Safety is taking no further action on the petition (VW2016-107).

On July 12, 2016 the Division issued an order. The Final Order was in response to a Petition for an emergency Variance from Building C and Building E, filed June 20, 2016, and advertised on June 23, 2016 in Vol. 42, No.122, of the Florida Administrative Register. No comments were received in response to the petition. The Final Order on the Petition for Variance grants the Petitioner a variance from Rule 303.3d, ASME A17.1, 1981 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires a supply line shut off valve in the machine room because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2016-143).

The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to share the bathrooms located within a nearby establishment under a different ownership for use by customers only.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 5 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.

The Final Order on the Petition for Variance grants the Petitioner a variance from Rules 2.2.4, 2.6.3, 2.7.4, 3.4.4, 3.9.2, 3.10.3, and 3.11.1, ASME A17.3, 1996 edition, as adopted by Rule 61C-5.001(1)(a) Florida Administrative Code that requires machine room ventilation, hoistway door vision panels, restricted door opening, car top emergency exit, final terminal stopping devices, top of car operating devices, and car emergency signals because the Petitioner has demonstrated that the purpose of the underlying statute has been met and that Petitioner would suffer a substantial hardship if required to comply with this rule (VW2016-151).
