To update the Annual Report of Midwifery Practice Form DH-MQA 5011 to add the address for submitting the form and to include instructions for completing the form.

Rules 69K-5.002, 69K-5.0021, and 69K-5.0022, F.A.C., are modified to update the application costs, pursuant to subsection 497.140(6), Florida Statutes (F.S.), which adds a “special unlicensed activity fee of $5.” Rule 69K-5.0022, F.A.C., is modified in subsection (3) to align with statutory requirements in paragraph 497.453(2)(f), F.S. Also, the last two sentences of paragraph (3)(c) are modified to reflect that they apply to all three paragraphs in subsection 69K-5.0022(3), F.A.C., and the remaining subsections are renumbered. Further, the forms in Rules 69K-5.0021, 69K-5.0022, 69K-5.0026, and 69K-5.013, F.A.C., were previously added to the forms rule, Rule 69K-1.001, F.A.C.; thus, these rules are modified to remove redundant date and incorporation information. Rule 69K-5.009, F.A.C., is modified to update cemetery site acreage requirements. For Rule 69K-5.011, F.A.C., the modification clarifies the electronic filing process according to subsection 497.141(13), F.S.
- Petitions and Dispositions Regarding Rule Variance or Waiver (4)

that it has issued a Final Order on June 23, 2017, granting KW Resort Utilities Corp’s Petition for a Variance for its wastewater treatment facility located in Key West. The Petition was received on May 15, 2017. Notice of receipt of this Petition was published in the Florida Administrative Register on June 6, 2017. The petition requested a variance from Rule 62-610.462(3), F.A.C, which establishes minimum staffing requirements at the Petitioner’s wastewater treatment facility. No public comment was received. The Final Order reduced the staffing requirement to 6 hours/day, 5 days/week provided there is no discharge to reuse facilities. The Final Order granted the variance to avoid the substantial economic hardship of requiring a certified operator even though the facility rarely produced reuse water on weekends.

The Notice of Petition for Waiver or Variance was published in Volume 43, Number 63, of the March 31, 2017, Florida Administrative Register. The Petitioner was seeking a waiver or variance of Rule 64B3-5.002(3)(a), Option 3b, Florida Administrative Code, entitled “Supervisor,” which sets forth the education, training/experience and examination requirements for licensure as a supervisor. The Board considered the instant Petition at a duly-noticed public telephonic meeting, held June 2, 2017.
The Board’s Order, filed on June 20, 2017, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B3-5.002(3)(a) Option 3b, F.A.C. The Board further finds that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.

This is a meeting of an Advisory Council required by Florida Statute 381.84. The council meets four times per year to provide advice to the Department of Health relating to the Comprehensive Tobacco Education and Use Prevention Program. The meetings will provide evaluation information and reports about the Tobacco Education and Use Prevention Program and each of the program’s major components including media, the cessation quitline, and community programs. The Florida Department of Transportation (FDOT) is holding a North and West Hillsborough County Community Working Groups meeting on Thursday, July 20th at 5:30 p.m. at The University Area Community Development Corporation Community Center Gymnasium, 14013 North 22nd Street, Tampa, FL 33613.
The group discussions include topics such as multi-modal transportation and evaluating infrastructure improvements in the context of a comprehensive regional transportation system.
To ensure a cross section of the community is represented, Community Working Group members were selected from within the community including individual citizens, neighborhood/HOA association representatives, civic and faith-based leaders, small business owners and business leaders, among others. The Community Working Group is open to the public. At the end of the workshop, time will be allotted for public comment. Narmo L. Ortiz; The Notice of Petition for Declaratory Statement published on July 9, 2010, in Vol. 36, No. 27, of the Florida Administrative Weekly. The petition sought the Board’s interpretation of Section 461.003(5), Florida Statutes, regarding whether the practice of hyperbaric oxygen for wound care of the foot, ankle, and leg is within the scope of practice set forth in the aforementioned statute. The Board of Podiatric Medicine considered the Petition at a duly noticed public meeting held on August 6, 2010, in Orlando, Florida. The Board=s Order was filed on July 14, 2017. The Board answered the question in the affirmative, finding that the use of hyperbaric oxygen for wound care of the foot, ankle, and leg is within the scope of practice for a podiatric physician in Florida.
