a Routine Variance for Subparagraph 61C-1.004(1)(a), Florida Administrative Code and Paragraph 5-202.11(A), 2009 FDA Food Code from Supreme Or LLC located in Pensacola. The above referenced F.A.C. addresses the requirement that each establishment have an approved plumbing system installed to transport potable water and wastewater. They are requesting to utilize holding tanks to provide potable water and to collect wastewater at the three compartment sink and the handwash sink.
The Division of Hotels and Restaurants will accept comments concerning the Petition for 14 days from the date of publication of this notice. To be considered, comments must be received before 5:00 p.m.

Waiver from Grace H. Yang, as counsel for Anheuser Busch, LLC. Notice of receipt of the Petition was published in Vol. 45, No. 49 of the Florida Administrative Register on April 23, 2019.
Petitioner requested a permanent waiver from paragraph 5E-14.111(2) & (3), F.A.C., which mandates requirements regarding structural fumigation and the evacuation of all occupants during the time of fumigation. Specifically, Petitioner requested a waiver of the requirement to vacate all connected structures during the fumigation.
On May 8, 2019, the Department sent a Request for Additional Information. Petitioner’s response was received on June 11, 2019.
On July 18, 2019, the Department issued an order granting the petition because the Petitioner demonstrated that its proposal to tape, seal and montior the fumigated area of the structure achieved the safety purposes of the underlying statute. Petitioner also demonstrated the existence of a substantial hardship should they be required to vacate the entire structure.
