The purpose and effect of the proposed rules is to update the definitions related to pari-mutuel cardroom operations. In addition, the rules related to cardroom games, notification in writing, card-play hands, dealer responsibilities, prohibitions, inspection of premises, records, cardroom operator licenses, cardroom business occupational licenses, cardroom employee occupational licenses and pari-mutuel/cardroom combination licenses, temporary cardroom employee occupational licenses, notification of criminal conviction or charge, duties of cardroom operators, display of identification and possession of occupational licenses, cards, dominoes, dominoes supervisors, chips and tokens, card and domino tables, admissions requirements, cardroom drop, count rooms, count procedures, reporting requirements to determine net proceeds or gross revenues, internal controls, drop box and key control procedures, tip box procedures, cardroom imprest tray, accounting for transactions between card table imprest tray and cardroom imprest bank, rake procedures, cardroom electronic surveillance, security plans, definition of poker, tournaments, jackpots, prizes, giveaways, and cashiers’ cages.

The purpose and effect of the proposed rule is to update the general duties and responsibilities, procedures relating to split samples, permitted medications for horses, veterinarians, penalty guidelines for class I-V drug violations in horses, and penalty guidelines for class I-V drug violations in greyhounds for pari-mutuel activity in the state of Florida.

The Commission is considering amendments to Chapter 68E-1, F.A.C., Marine Turtle Permits and the Marine Turtle Conservation Guidelines. The proposed amendments will clarify and update existing rule language to reflect current procedures for review and approval of applications, add definitions for terms in the existing Rule and clarify criteria and timelines for review and approval of applications. Language is also proposed to address stakeholder concerns on review and approval of requests for research involving threatened or endangered marine turtles. Four workshops are proposed; staff will present the same content at each meeting with opportunities for public comment.

The Department proposes to adopt a new environmental resource general permit for public mooring fields. This general permit is required by Chapter 2013-92, Laws of Florida, which amended Section 373.118(4), F.S., that became effective July 1, 2013.
Under Section 373.118(1), F.S., this general permit must result in, individually and cumulatively, no more than a minimal adverse environmental effect on water resources. In accordance with Section 373.118(4), F.S., this general permit shall: (1) require any public mooring field to be constructed, maintained, and operated for the exclusive use of the general public; (2) include provisions to ensure compliance with Part IV of Chapter 373, F.S.; (3) incorporate criteria necessary to be included in a state programmatic general permit issued by the United States Army Corps of Engineers under Section 404 of the Clean Water Act, Public Law 92-500, as amended, 33 U.S.C. ss. 1251 et seq.; (4) be consistent with the local government manatee protection plan required by Chapter 379, F.S.; and (5) authorize up to 100 vessels for a public mooring field. All of these requirements are addressed by the proposed new general permit, except number (3) which will require future coordination between the Corps of Engineers and the Department after the general permit becomes effective, and will require additional rulemaking.
This general permit additionally requires sovereignty submerged land leases when these public mooring fields are located on state-owned submerged land. The Department will seek formal delegation of authority from the Board of Trustees of the Internal Improvement Trust Fund to the Department to issue leases for public mooring fields that qualify under Section 373.118(4), F.S.
In accordance with Section 373.118(4), F.S., any facility authorized under this general permit that complies with the comprehensive plan of the applicable local government, will be exempt from review as a development of regional impact.

The Department of Elder Affairs (“Department”) proposes the repeal of rules 58N-1.001, 58N-1.009, 58N-1.011, 58N-1.013, 58N-1.015, 58N-1.017 and 58N-1.019, Florida Administrative Code, because the legislature eliminated the sections of the Florida Statutes that provided for the establishment of long-term care community diversion pilot projects during the 2014 legislative session; therefore, the Department has determined that these rules are unnecessary.

The Department issued an order denying the request made by Redlands Christian Migrant Association, for a variance from Rule 6A-1.09433(1)(b), F.A.C. , Voluntary Prekindergarten Pre- and Post-Assessments. The petition was filed with the Department of Education’s Clerk on or around June 8, 2015 and is dated May 18, 2015. Notice of the petition was published on June 10, 2015 in Volume 41, page 112 of the Florida Administrative Register. The order denying the request was filed on August 17, 2015. The order denies the request of the VPK provider to use an alternative to the Teaching Strategies Gold assessment. The reasons for the denial of the request, set our more fully in the order, are (1) the agency lacks the authority to grant the request, (2) the request is inconsistent with the purpose of the statute to create a uniform system of measurement for VPK providers, and (3) the petition fails to demonstrate a substantial hardship created by imposition of the rule as noticed and adopted.
