of the issuance of an Order regarding the Petition for Waiver or Variance, filed on May 1, 2019, by John F. Albritton. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 94, of the May 14, 2019, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61G4-16.005, F.A.C., entitled “Duration of Validity,” that requires for the purpose of certification, a passing grade shall be valid only for a period of four (4) years from the date of the most recently passed portion of the exam.
The Board considered the instant Petition at a duly-noticed public meeting, held July 12, 2019, in Coral Gables, Florida. The Board’s Order, filed on August 6, 2019, denied the petition finding that Petitioner had failed to establish that the purpose of the underlying statute would be met by granting a variance from Rule 61G4-16.005, F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness or impose substantial hardship.
